55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the examination attempt limits for certain applicants
88 seeking a license to practice medicine.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 155.056(d), Occupations Code, is amended
1111 to read as follows:
1212 (d) The limitation on examination attempts by an applicant
1313 under Subsection (a) does not apply to an applicant who:
1414 (1) is licensed and in good standing as a physician in
1515 another state;
1616 (2) has been licensed for at least five years;
1717 (3) does not hold a medical license in the other state
1818 that has any restrictions, disciplinary orders, or probation; and
1919 (4) passed all but one part of the examination
2020 approved by the board within three attempts and:
2121 (A) passed the remaining part of the examination
2222 within one additional attempt; or
2323 (B) passed the remaining part of the examination
2424 within six attempts if the applicant[:
2525 [(i)] is specialty board certified by a
2626 specialty board that:
2727 (i) [(a)] is a member of the American Board
2828 of Medical Specialties; or
2929 (ii) [(b)] is approved by the American
3030 Osteopathic Association[; and
3131 [(ii) has completed in this state an
3232 additional two years of postgraduate medical training approved by
3333 the board].
3434 SECTION 2. Section 155.056(d), Occupations Code, as amended
3535 by this Act, applies to an application for a license to practice
3636 medicine that is pending before the Texas Medical Board on the
3737 effective date of this Act or filed on or after that date.
3838 SECTION 3. This Act takes effect September 1, 2017.
