| 7 | 7 | | relating to the examination attempt limits for certain applicants |

| 8 | 8 | | seeking a license to practice medicine. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 155.056(d), Occupations Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | (d) The limitation on examination attempts by an applicant |
|---|
| 13 | 13 | | under Subsection (a) does not apply to an applicant who: |
|---|
| 14 | 14 | | (1) is licensed and in good standing as a physician in |
|---|
| 15 | 15 | | another state; |
|---|
| 16 | 16 | | (2) has been licensed for at least five years; |
|---|
| 17 | 17 | | (3) does not hold a medical license in the other state |
|---|
| 18 | 18 | | that has any restrictions, disciplinary orders, or probation; and |
|---|
| 19 | 19 | | (4) passed all but one part of the examination |
|---|
| 20 | 20 | | approved by the board within three attempts and: |
|---|
| 21 | 21 | | (A) passed the remaining part of the examination |
|---|
| 22 | 22 | | within one additional attempt; or |
|---|
| 23 | 23 | | (B) passed the remaining part of the examination |
|---|
| 24 | 24 | | within six attempts if the applicant[: |
|---|
| 25 | 25 | | [(i)] is specialty board certified by a |
|---|
| 26 | 26 | | specialty board that: |
|---|
| 27 | 27 | | (i) [(a)] is a member of the American Board |
|---|
| 28 | 28 | | of Medical Specialties; or |
|---|
| 29 | 29 | | (ii) [(b)] is approved by the American |
|---|
| 30 | 30 | | Osteopathic Association[; and |
|---|
| 31 | 31 | | [(ii) has completed in this state an |
|---|
| 32 | 32 | | additional two years of postgraduate medical training approved by |
|---|
| 33 | 33 | | the board]. |
|---|
| 34 | 34 | | SECTION 2. Section 155.056(d), Occupations Code, as amended |
|---|
| 35 | 35 | | by this Act, applies to an application for a license to practice |
|---|
| 36 | 36 | | medicine that is pending before the Texas Medical Board on the |
|---|
| 37 | 37 | | effective date of this Act or filed on or after that date. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2017. |
