| 10 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 9 | | SECTION 1. Section 9, Article 38.01, Code of Criminal |

| 12 | 10 | | Procedure, is amended to read as follows: |
|---|
| 13 | 11 | | Sec. 9. ADMINISTRATIVE ATTACHMENT TO OFFICE OF COURT |
|---|
| 14 | 12 | | ADMINISTRATION [SAM HOUSTON STATE UNIVERSITY]. (a) The |
|---|
| 15 | 13 | | commission is administratively attached to the Office of Court |
|---|
| 16 | 14 | | Administration of the Texas Judicial System [Sam Houston State |
|---|
| 17 | 15 | | University]. |
|---|
| 18 | 16 | | (b) The Office of Court Administration of the Texas Judicial |
|---|
| 19 | 17 | | System [Board of Regents of the Texas State University System] |
|---|
| 20 | 18 | | shall provide administrative support to the commission as necessary |
|---|
| 21 | 19 | | to enable the commission to carry out the purposes of this article. |
|---|
| 22 | 20 | | (c) Only the commission may exercise the duties of the |
|---|
| 23 | 21 | | commission under this article. Except as provided by Subsection |
|---|
| 24 | 22 | | (b), the Office of Court Administration of the Texas Judicial |
|---|
| 25 | 23 | | System does not have [neither the Board of Regents of the Texas |
|---|
| 26 | 24 | | State University System nor Sam Houston State University has] any |
|---|
| 27 | 25 | | authority or responsibility with respect to the duties of the |
|---|
| 28 | 26 | | commission under this article. |
|---|
| 29 | 27 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 30 | 28 | | of this Act, Sam Houston State University and the Office of Court |
|---|
| 31 | 29 | | Administration of the Texas Judicial System shall adopt a |
|---|
| 32 | 30 | | memorandum of understanding to provide for the transfer of the |
|---|
| 33 | 31 | | administrative attachment of the Texas Forensic Science Commission |
|---|
| 34 | 32 | | to the office, including any necessary transfer of employees, |
|---|
| 35 | 33 | | records, equipment, and supplies. The memorandum of understanding |
|---|
| 36 | 34 | | must provide for the transfer to be completed not later than |
|---|
| 37 | 35 | | December 1, 2017. |
|---|
| 38 | 36 | | SECTION 3. This Act takes effect September 1, 2017. |
