66 AN ACT
77 relating to the temporary continuation of medical assistance for
88 certain individuals with intellectual or developmental
99 disabilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1212 is amended by adding Section 32.0256 to read as follows:
1313 Sec. 32.0256. TEMPORARY CONTINUATION OF MEDICAL ASSISTANCE
1414 FOR CERTAIN INDIVIDUALS WITH INTELLECTUAL OR DEVELOPMENTAL
1515 DISABILITIES. (a) The commission shall continue to provide
1616 medical assistance to an individual with an intellectual or
1717 developmental disability after the expiration of the period for
1818 which the individual was certified as eligible for medical
1919 assistance if the individual:
2020 (1) receives services through a program authorized
2121 under Section 1915(c), Social Security Act (42 U.S.C. Section
2222 1396n(c));
2323 (2) receives basic attendant and habilitation
2424 services under the STAR + PLUS Medicaid managed care program; or
2525 (3) resides in an ICF-IID facility.
2626 (b) The commission shall continue to provide medical
2727 assistance under Subsection (a) until the earlier of:
2828 (1) the end of the 90-day period following the date on
2929 which the individual's eligibility period expired; or
3030 (2) the date the individual is otherwise recertified
3131 as eligible or determined ineligible for medical assistance after
3232 having reapplied for the assistance.
3333 SECTION 2. If before implementing any provision of this Act
3434 a state agency determines that a waiver or authorization from a
3535 federal agency is necessary for implementation of that provision,
3636 the agency affected by the provision shall request the waiver or
3737 authorization and may delay implementing that provision until the
3838 waiver or authorization is granted.
3939 SECTION 3. This Act takes effect September 1, 2017.
