7 | 7 | | relating to the temporary continuation of medical assistance for |

8 | 8 | | certain individuals with intellectual or developmental |
---|
9 | 9 | | disabilities. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 32, Human Resources Code, |
---|
12 | 12 | | is amended by adding Section 32.0256 to read as follows: |
---|
13 | 13 | | Sec. 32.0256. TEMPORARY CONTINUATION OF MEDICAL ASSISTANCE |
---|
14 | 14 | | FOR CERTAIN INDIVIDUALS WITH INTELLECTUAL OR DEVELOPMENTAL |
---|
15 | 15 | | DISABILITIES. (a) The commission shall continue to provide |
---|
16 | 16 | | medical assistance to an individual with an intellectual or |
---|
17 | 17 | | developmental disability after the expiration of the period for |
---|
18 | 18 | | which the individual was certified as eligible for medical |
---|
19 | 19 | | assistance if the individual: |
---|
20 | 20 | | (1) receives services through a program authorized |
---|
21 | 21 | | under Section 1915(c), Social Security Act (42 U.S.C. Section |
---|
22 | 22 | | 1396n(c)); |
---|
23 | 23 | | (2) receives basic attendant and habilitation |
---|
24 | 24 | | services under the STAR + PLUS Medicaid managed care program; or |
---|
25 | 25 | | (3) resides in an ICF-IID facility. |
---|
26 | 26 | | (b) The commission shall continue to provide medical |
---|
27 | 27 | | assistance under Subsection (a) until the earlier of: |
---|
28 | 28 | | (1) the end of the 90-day period following the date on |
---|
29 | 29 | | which the individual's eligibility period expired; or |
---|
30 | 30 | | (2) the date the individual is otherwise recertified |
---|
31 | 31 | | as eligible or determined ineligible for medical assistance after |
---|
32 | 32 | | having reapplied for the assistance. |
---|
33 | 33 | | SECTION 2. If before implementing any provision of this Act |
---|
34 | 34 | | a state agency determines that a waiver or authorization from a |
---|
35 | 35 | | federal agency is necessary for implementation of that provision, |
---|
36 | 36 | | the agency affected by the provision shall request the waiver or |
---|
37 | 37 | | authorization and may delay implementing that provision until the |
---|
38 | 38 | | waiver or authorization is granted. |
---|
39 | 39 | | SECTION 3. This Act takes effect September 1, 2017. |
