7 | 7 | | relating to the first day of instruction at a public school in a |
---|
8 | 8 | | district of innovation. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 12A.003, Education Code, is amended by |
---|
11 | 11 | | amending Subsection (b) and adding Subsection (c) to read as |
---|
12 | 12 | | follows: |
---|
13 | 13 | | (b) A local innovation plan must: |
---|
14 | 14 | | (1) provide for a comprehensive educational program |
---|
15 | 15 | | for the district, which program may include: |
---|
16 | 16 | | (A) innovative curriculum, instructional |
---|
17 | 17 | | methods, and provisions regarding community participation, campus |
---|
18 | 18 | | governance, and parental involvement; |
---|
19 | 19 | | (B) except as provided by Section 12A.004(a), |
---|
20 | 20 | | modifications to the school day or year; |
---|
21 | 21 | | (C) provisions regarding the district budget and |
---|
22 | 22 | | sustainable program funding; |
---|
23 | 23 | | (D) accountability and assessment measures that |
---|
24 | 24 | | exceed the requirements of state and federal law; and |
---|
25 | 25 | | (E) any other innovations prescribed by the board |
---|
26 | 26 | | of trustees; and |
---|
27 | 27 | | (2) identify requirements imposed by this code that |
---|
28 | 28 | | inhibit the goals of the plan and from which the district should be |
---|
29 | 29 | | exempted on adoption of the plan, subject to Section 12A.004. |
---|
30 | 30 | | (c) A school district designated as a district of innovation |
---|
31 | 31 | | before June 1, 2017, may include modifications to the school year in |
---|
32 | 32 | | the local innovation plan. |
---|
33 | 33 | | SECTION 2. Section 12A.004, Education Code, is amended by |
---|
34 | 34 | | amending Subsection (a) and adding Subsection (c) to read as |
---|
35 | 35 | | follows: |
---|
36 | 36 | | (a) A local innovation plan may not provide for the |
---|
37 | 37 | | exemption of a district designated as a district of innovation from |
---|
38 | 38 | | the following provisions of this title: |
---|
39 | 39 | | (1) a state or federal requirement applicable to an |
---|
40 | 40 | | open-enrollment charter school operating under Subchapter D, |
---|
41 | 41 | | Chapter 12; |
---|
42 | 42 | | (2) Subchapters A, C, D, and E, Chapter 11, except that |
---|
43 | 43 | | a district may be exempt from Sections 11.1511(b)(5) and (14) and |
---|
44 | 44 | | Section 11.162; |
---|
45 | 45 | | (3) state curriculum and graduation requirements |
---|
46 | 46 | | adopted under Chapter 28; [and] |
---|
47 | 47 | | (4) academic and financial accountability and |
---|
48 | 48 | | sanctions under Chapter 39; and |
---|
49 | 49 | | (5) the first day of instruction requirement under |
---|
50 | 50 | | Section 25.0811. |
---|
51 | 51 | | (c) Notwithstanding any other provision of this section, |
---|
52 | 52 | | the local innovation plan of a school district designated as a |
---|
53 | 53 | | district of innovation before June 1, 2017, may provide for the |
---|
54 | 54 | | exemption of the district from the first day of instruction |
---|
55 | 55 | | requirement under Section 25.0811. |
---|
56 | 56 | | SECTION 3. This Act takes effect immediately if it receives |
---|
57 | 57 | | a vote of two-thirds of all the members elected to each house, as |
---|
58 | 58 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
59 | 59 | | Act does not receive the vote necessary for immediate effect, this |
---|
60 | 60 | | Act takes effect September 1, 2017. |
