9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 8 | | SECTION 1. Section 39.452, Utilities Code, is amended by |
---|
11 | 9 | | adding Subsections (k) and (l) to read as follows: |
---|
12 | 10 | | (k) Notwithstanding Subsection (d), an electric utility |
---|
13 | 11 | | subject to this subchapter that elects to deploy advanced metering |
---|
14 | 12 | | and meter information networks may recover reasonable and necessary |
---|
15 | 13 | | costs incurred in deploying advanced metering and meter information |
---|
16 | 14 | | networks. An electric utility that elects to deploy advanced |
---|
17 | 15 | | metering or meter information networks is subject to commission |
---|
18 | 16 | | rules adopted under Sections 39.107(h) and (k). The commission |
---|
19 | 17 | | shall ensure that any deployment plan approved under this section |
---|
20 | 18 | | and any related customer surcharge: |
---|
21 | 19 | | (1) are not applicable to customer accounts that |
---|
22 | 20 | | receive service at transmission voltage; and |
---|
23 | 21 | | (2) are consistent with commission rules related to |
---|
24 | 22 | | advanced metering systems regarding: |
---|
25 | 23 | | (A) customer protections; |
---|
26 | 24 | | (B) data security, privacy, and ownership; and |
---|
27 | 25 | | (C) options given consumers to continue to |
---|
28 | 26 | | receive service through a non-advanced meter. |
---|
29 | 27 | | (l) An electric utility subject to this subchapter that |
---|
30 | 28 | | elects to deploy an advanced meter information network shall deploy |
---|
31 | 29 | | the network as rapidly as practicable to allow customers to better |
---|
32 | 30 | | manage energy use and control costs. |
---|
33 | 31 | | SECTION 2. This Act takes effect immediately if it receives |
---|
34 | 32 | | a vote of two-thirds of all the members elected to each house, as |
---|
35 | 33 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
36 | 34 | | Act does not receive the vote necessary for immediate effect, this |
---|
37 | 35 | | Act takes effect September 1, 2017. |
