75 relating to the deployment of advanced metering and meter
86 information networks in certain non-ERCOT areas.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 39.452, Utilities Code, is amended by
119 adding Subsections (k) and (l) to read as follows:
1210 (k) Notwithstanding Subsection (d), an electric utility
1311 subject to this subchapter that elects to deploy advanced metering
1412 and meter information networks may recover reasonable and necessary
1513 costs incurred in deploying advanced metering and meter information
1614 networks. An electric utility that elects to deploy advanced
1715 metering or meter information networks is subject to commission
1816 rules adopted under Sections 39.107(h) and (k). The commission
1917 shall ensure that any deployment plan approved under this section
2018 and any related customer surcharge:
2119 (1) are not applicable to customer accounts that
2220 receive service at transmission voltage; and
2321 (2) are consistent with commission rules related to
2422 advanced metering systems regarding:
2523 (A) customer protections;
2624 (B) data security, privacy, and ownership; and
2725 (C) options given consumers to continue to
2826 receive service through a non-advanced meter.
2927 (l) An electric utility subject to this subchapter that
3028 elects to deploy an advanced meter information network shall deploy
3129 the network as rapidly as practicable to allow customers to better
3230 manage energy use and control costs.
3331 SECTION 2. This Act takes effect immediately if it receives
3432 a vote of two-thirds of all the members elected to each house, as
3533 provided by Section 39, Article III, Texas Constitution. If this
3634 Act does not receive the vote necessary for immediate effect, this
3735 Act takes effect September 1, 2017.
