| 7 | 7 | | relating to the Alamo complex account; making an appropriation. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 403.0956, Government Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 403.0956. REALLOCATION OF INTEREST ACCRUED ON CERTAIN |
|---|
| 12 | 12 | | DEDICATED REVENUE. Notwithstanding any other law, all interest or |
|---|
| 13 | 13 | | other earnings that accrue on all revenue held in an account in the |
|---|
| 14 | 14 | | general revenue fund any part of which Section 403.095 makes |
|---|
| 15 | 15 | | available for certification under Section 403.121 are available for |
|---|
| 16 | 16 | | any general governmental purpose, and the comptroller shall deposit |
|---|
| 17 | 17 | | the interest and earnings to the credit of the general revenue |
|---|
| 18 | 18 | | fund. This section does not apply to: |
|---|
| 19 | 19 | | (1) interest or earnings on revenue deposited in |
|---|
| 20 | 20 | | accordance with Section 51.008, Education Code; |
|---|
| 21 | 21 | | (2) an account that accrues interest or other earnings |
|---|
| 22 | 22 | | on deposits of state or federal money the diversion of which is |
|---|
| 23 | 23 | | specifically excluded by federal law; |
|---|
| 24 | 24 | | (3) the lifetime license endowment account; |
|---|
| 25 | 25 | | (4) the game, fish, and water safety account; |
|---|
| 26 | 26 | | (5) the coastal protection account; or |
|---|
| 27 | 27 | | (6) [the Alamo complex account; or |
|---|
| 28 | 28 | | [(7)] the artificial reef account. |
|---|
| 29 | 29 | | SECTION 2. Section 31.454(a), Natural Resources Code, is |
|---|
| 30 | 30 | | amended to read as follows: |
|---|
| 31 | 31 | | (a) The Alamo complex account is created as an account |
|---|
| 32 | 32 | | outside the state treasury. The land office shall administer the |
|---|
| 33 | 33 | | account [a separate account in the general revenue fund]. |
|---|
| 34 | 34 | | SECTION 3. Section 31.454(d), Natural Resources Code, is |
|---|
| 35 | 35 | | repealed. |
|---|
| 36 | 36 | | SECTION 4. The unencumbered balance of the Alamo complex |
|---|
| 37 | 37 | | account in the general revenue fund as that account exists |
|---|
| 38 | 38 | | immediately before the effective date of this Act is appropriated |
|---|
| 39 | 39 | | to the comptroller of public accounts for the period beginning on |
|---|
| 40 | 40 | | the effective date of this Act and ending August 31, 2018, for the |
|---|
| 41 | 41 | | purpose of depositing, as soon as practicable, the money to the |
|---|
| 42 | 42 | | credit of the Alamo complex account created outside the state |
|---|
| 43 | 43 | | treasury by Section 31.454(a), Natural Resources Code, as amended |
|---|
| 44 | 44 | | by this Act. |
|---|
| 45 | 45 | | SECTION 5. This Act takes effect September 1, 2017. |
