77 relating to the payment of gratuities to certain employees.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 61, Labor Code, is amended
1010 by adding Section 61.021 to read as follows:
1111 Sec. 61.021. GRATUITIES PAID TO TIPPED EMPLOYEES. (a) In
1212 this section, "tipped employee" has the meaning assigned by Section
1313 62.052.
1414 (b) A gratuity paid to or left for a tipped employee is the
1515 property of the tipped employee. An employer may not collect or
1616 receive any portion of the gratuity for the purpose of compensating
1717 a credit or debit card issuer for any financial services rendered on
1818 account of the gratuity.
1919 SECTION 2. Section 61.021, Labor Code, as added by this Act,
2020 applies only to a gratuity paid to or left for an employee on or
2121 after the effective date of this Act.
2222 SECTION 3. This Act takes effect September 1, 2017.
