55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to abolishing certain county boards of education, boards
88 of county school trustees, and offices of county school
99 superintendent.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) Each county board of education, board of
1212 county school trustees, and office of county school superintendent
1313 in a county with a population of 3.3 million or more is abolished
1414 effective September 1, 2017.
1515 (b) All assets, liabilities, and contracts of a board
1616 abolished by this Act are transferred to the commissioners court of
1717 the county in trust for the component school districts in the
1818 county. The commissioners court shall, not later than September 1,
1919 2018, distribute the assets remaining after discharge of the
2020 board's liabilities to the component school districts in the county
2121 in proportionate shares equal to the proportion that the membership
2222 in each district bears to total membership in the county as of May
2323 1, 2017. The commissioners court may liquidate board assets as
2424 necessary to discharge board liabilities and facilitate the
2525 distribution of assets. A person authorized by the board shall
2626 execute any documents necessary to complete the transfer of assets,
2727 liabilities, or contracts.
2828 (c) The component school districts of a board abolished by
2929 this Act shall collect and use any delinquent taxes imposed by the
3030 board in the manner provided by rule of the commissioner of
3131 education.
3232 SECTION 2. Section 52.092(e), Election Code, is amended to
3333 read as follows:
3434 (e) County offices shall be listed in the following order:
3535 (1) county judge;
3636 (2) judge, county court at law;
3737 (3) judge, county criminal court;
3838 (4) judge, county probate court;
3939 (5) county attorney;
4040 (6) district clerk;
4141 (7) district and county clerk;
4242 (8) county clerk;
4343 (9) sheriff;
4444 (10) sheriff and tax assessor-collector;
4545 (11) county tax assessor-collector;
4646 (12) county treasurer;
4747 (13) [county school trustee (county with population of
4848 3.3 million or more);
4949 [(14)] county surveyor.
5050 SECTION 3. Chapter 595 (H.B. 689), Acts of the 59th
5151 Legislature, Regular Session, 1965 (Article 2676c, Vernon's Texas
5252 Civil Statutes), is repealed.
5353 SECTION 4. This Act takes effect September 1, 2017.
