| 9 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 8 | | SECTION 1. Subtitle A, Title 3, Alcoholic Beverage Code, is |
|---|
| 11 | 9 | | amended by adding Chapter 56 to read as follows: |
|---|
| 12 | 10 | | CHAPTER 56. WATER PARK PERMIT |
|---|
| 13 | 11 | | Sec. 56.01. AUTHORIZED ACTIVITIES. Notwithstanding any |
|---|
| 14 | 12 | | other provision of this code, the holder of two or more water park |
|---|
| 15 | 13 | | permits may deliver alcoholic beverages from any premises for which |
|---|
| 16 | 14 | | one of those permits has been issued to any other premises for which |
|---|
| 17 | 15 | | one of those permits has been issued. |
|---|
| 18 | 16 | | Sec. 56.02. QUALIFICATIONS FOR PERMIT; ELIGIBLE PREMISES. |
|---|
| 19 | 17 | | (a) A water park permit may be issued only to a person who: |
|---|
| 20 | 18 | | (1) holds a wine and beer retailer's permit under |
|---|
| 21 | 19 | | Chapter 25; and |
|---|
| 22 | 20 | | (2) operates a public venue that: |
|---|
| 23 | 21 | | (A) involves waterslides, food service, music, |
|---|
| 24 | 22 | | and amusement activities; and |
|---|
| 25 | 23 | | (B) is located primarily along the banks of the |
|---|
| 26 | 24 | | Comal River. |
|---|
| 27 | 25 | | (b) A person described by Subsection (a) may be issued water |
|---|
| 28 | 26 | | park permits for not more than five premises: |
|---|
| 29 | 27 | | (1) for which wine and beer retailer's permits have |
|---|
| 30 | 28 | | been issued under Chapter 25; and |
|---|
| 31 | 29 | | (2) that are located: |
|---|
| 32 | 30 | | (A) in the public venue described in Subsection |
|---|
| 33 | 31 | | (a)(2); or |
|---|
| 34 | 32 | | (B) not more than one mile from the boundary of |
|---|
| 35 | 33 | | that venue. |
|---|
| 36 | 34 | | Sec. 56.03. FEE. The annual state fee for a water park |
|---|
| 37 | 35 | | permit is $30. |
|---|
| 38 | 36 | | Sec. 56.04. APPLICABILITY OF OTHER LAW. Except as |
|---|
| 39 | 37 | | otherwise provided in this chapter, the provisions of this code |
|---|
| 40 | 38 | | applicable to a wine and beer retailer's permit apply to a water |
|---|
| 41 | 39 | | park permit. |
|---|
| 42 | 40 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 43 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 44 | | Act takes effect September 1, 2017. |
