75 relating to the creation of a water park permit in the Alcoholic
86 Beverage Code; authorizing a fee.
97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Subtitle A, Title 3, Alcoholic Beverage Code, is
119 amended by adding Chapter 56 to read as follows:
1210 CHAPTER 56. WATER PARK PERMIT
1311 Sec. 56.01. AUTHORIZED ACTIVITIES. Notwithstanding any
1412 other provision of this code, the holder of two or more water park
1513 permits may deliver alcoholic beverages from any premises for which
1614 one of those permits has been issued to any other premises for which
1715 one of those permits has been issued.
1816 Sec. 56.02. QUALIFICATIONS FOR PERMIT; ELIGIBLE PREMISES.
1917 (a) A water park permit may be issued only to a person who:
2018 (1) holds a wine and beer retailer's permit under
2119 Chapter 25; and
2220 (2) operates a public venue that:
2321 (A) involves waterslides, food service, music,
2422 and amusement activities; and
2523 (B) is located primarily along the banks of the
2624 Comal River.
2725 (b) A person described by Subsection (a) may be issued water
2826 park permits for not more than five premises:
2927 (1) for which wine and beer retailer's permits have
3028 been issued under Chapter 25; and
3129 (2) that are located:
3230 (A) in the public venue described in Subsection
3331 (a)(2); or
3432 (B) not more than one mile from the boundary of
3533 that venue.
3634 Sec. 56.03. FEE. The annual state fee for a water park
3735 permit is $30.
3836 Sec. 56.04. APPLICABILITY OF OTHER LAW. Except as
3937 otherwise provided in this chapter, the provisions of this code
4038 applicable to a wine and beer retailer's permit apply to a water
4139 park permit.
4240 SECTION 2. This Act takes effect immediately if it receives
4341 a vote of two-thirds of all the members elected to each house, as
4442 provided by Section 39, Article III, Texas Constitution. If this
4543 Act does not receive the vote necessary for immediate effect, this
4644 Act takes effect September 1, 2017.
