97 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
108 SECTION 1. Section 221.0071, Human Resources Code, is
119 amended to read as follows:
1210 Sec. 221.0071. CHARTER SCHOOL. (a) Notwithstanding any
1311 other law and in addition to the number of charters allowed under
1412 Subchapter D, Chapter 12, Education Code, the commissioner of
1513 education may grant a charter on the application of a detention,
1614 correctional, or residential facility established only for
1715 juvenile offenders under Section 51.12, 51.125, or 51.126, Family
1816 Code, or an eligible entity that has entered into a contract with a
1917 facility described by this subsection.
2018 (b) If a local detention, correctional, or residential
2119 facility described by Subsection (a) or an eligible entity that has
2220 entered into a contract with a facility described by Subsection (a)
2321 applies for a charter, the facility or the eligible entity must
2422 provide all educational opportunities and services, including
2523 special education instruction and related services, that a school
2624 district is required under state or federal law to provide for
2725 students residing in the district through a charter school operated
2826 in accordance with and subject to Subchapter D, Chapter 12,
2927 Education Code.
3028 (c) The commissioner of education shall adopt a form and
3129 procedure to allow a detention, correctional, or residential
3230 facility described by Subsection (a) or an eligible entity that has
3331 entered into a contract with a facility described by Subsection (a)
3432 to apply for a charter. The application form and procedure must be
3533 comparable to the applicable requirements of Section 12.110,
3634 Education Code, and must include any requirements provided under
3735 Subchapter D, Chapter 12, Education Code.
3836 (d) A charter school operating under a charter granted under
3937 this section is entitled to receive open-enrollment charter school
4038 funding under Chapter 42, Education Code, in the same manner as an
4139 open-enrollment charter school operating under Subchapter D,
4240 Chapter 12, Education Code.
4341 (e) The commissioner of education shall adopt rules
4442 necessary to implement this section, including rules that modify
4543 the requirements for charter schools provided under Chapter 12,
4644 Education Code, as necessary to allow a charter school to operate in
4745 a detention, correctional, or residential facility described by
4846 Subsection (a).
4947 (f) In this section, "eligible entity" has the meaning
5048 assigned by Section 12.101(a), Education Code.
5149 SECTION 2. This Act takes effect September 1, 2017.
