| 7 | 7 | | relating to the Internet broadcast of open meetings of the Texas |

| 8 | 8 | | Lottery Commission. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 467, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 467.0301 to read as follows: |
|---|
| 12 | 12 | | Sec. 467.0301. INTERNET BROADCAST AND ARCHIVE OF OPEN |
|---|
| 13 | 13 | | MEETINGS. (a) The commission shall: |
|---|
| 14 | 14 | | (1) broadcast over the Internet live video and audio |
|---|
| 15 | 15 | | of each open meeting of the commission; |
|---|
| 16 | 16 | | (2) make a video and audio recording of reasonable |
|---|
| 17 | 17 | | quality of the broadcast; and |
|---|
| 18 | 18 | | (3) provide access to the archived video and audio on |
|---|
| 19 | 19 | | the commission's Internet website. |
|---|
| 20 | 20 | | (b) Not later than the seventh day after the date an open |
|---|
| 21 | 21 | | meeting is broadcast under this section, the commission shall make |
|---|
| 22 | 22 | | available through the commission's Internet website archived video |
|---|
| 23 | 23 | | and audio of the open meeting. The commission shall maintain the |
|---|
| 24 | 24 | | archived video and audio of the open meeting on the commission's |
|---|
| 25 | 25 | | Internet website for not less than two years after the date the |
|---|
| 26 | 26 | | archived video and audio was first made available on the website. |
|---|
| 27 | 27 | | (c) The commission shall provide on the commission's |
|---|
| 28 | 28 | | Internet website the same notice of the open meeting that the |
|---|
| 29 | 29 | | commission is required to post under Subchapter C, Chapter 551. The |
|---|
| 30 | 30 | | notice must be posted on the commission's Internet website within |
|---|
| 31 | 31 | | the time required for posting notice under Subchapter C, Chapter |
|---|
| 32 | 32 | | 551. |
|---|
| 33 | 33 | | (d) The commission may use for an Internet broadcast of an |
|---|
| 34 | 34 | | open meeting of the commission a room made available to the |
|---|
| 35 | 35 | | commission on request in any state building, as that term is defined |
|---|
| 36 | 36 | | by Section 2165.301. |
|---|
| 37 | 37 | | (e) The commission is exempt from the requirements of this |
|---|
| 38 | 38 | | section to the extent a catastrophe, as defined by Section |
|---|
| 39 | 39 | | 551.0411, or a technical breakdown prevents the commission from |
|---|
| 40 | 40 | | complying with this section. Following the catastrophe or |
|---|
| 41 | 41 | | technical breakdown, the commission shall make all reasonable |
|---|
| 42 | 42 | | efforts to make the required video and audio of the open meeting |
|---|
| 43 | 43 | | available in a timely manner. |
|---|
| 44 | 44 | | (f) The commission shall consider contracting through |
|---|
| 45 | 45 | | competitive bidding with a private individual or entity to |
|---|
| 46 | 46 | | broadcast and archive an open meeting subject to this section to |
|---|
| 47 | 47 | | minimize the cost of complying with this section. |
|---|
| 48 | 48 | | SECTION 2. Section 467.0301, Government Code, as added by |
|---|
| 49 | 49 | | this Act, applies only to an open meeting held on or after September |
|---|
| 50 | 50 | | 1, 2019. |
|---|
| 51 | 51 | | SECTION 3. This Act takes effect September 1, 2017. |
