66 AN ACT
77 relating to the Internet broadcast of open meetings of the Texas
88 Lottery Commission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 467, Government Code, is
1111 amended by adding Section 467.0301 to read as follows:
1212 Sec. 467.0301. INTERNET BROADCAST AND ARCHIVE OF OPEN
1313 MEETINGS. (a) The commission shall:
1414 (1) broadcast over the Internet live video and audio
1515 of each open meeting of the commission;
1616 (2) make a video and audio recording of reasonable
1717 quality of the broadcast; and
1818 (3) provide access to the archived video and audio on
1919 the commission's Internet website.
2020 (b) Not later than the seventh day after the date an open
2121 meeting is broadcast under this section, the commission shall make
2222 available through the commission's Internet website archived video
2323 and audio of the open meeting. The commission shall maintain the
2424 archived video and audio of the open meeting on the commission's
2525 Internet website for not less than two years after the date the
2626 archived video and audio was first made available on the website.
2727 (c) The commission shall provide on the commission's
2828 Internet website the same notice of the open meeting that the
2929 commission is required to post under Subchapter C, Chapter 551. The
3030 notice must be posted on the commission's Internet website within
3131 the time required for posting notice under Subchapter C, Chapter
3232 551.
3333 (d) The commission may use for an Internet broadcast of an
3434 open meeting of the commission a room made available to the
3535 commission on request in any state building, as that term is defined
3636 by Section 2165.301.
3737 (e) The commission is exempt from the requirements of this
3838 section to the extent a catastrophe, as defined by Section
3939 551.0411, or a technical breakdown prevents the commission from
4040 complying with this section. Following the catastrophe or
4141 technical breakdown, the commission shall make all reasonable
4242 efforts to make the required video and audio of the open meeting
4343 available in a timely manner.
4444 (f) The commission shall consider contracting through
4545 competitive bidding with a private individual or entity to
4646 broadcast and archive an open meeting subject to this section to
4747 minimize the cost of complying with this section.
4848 SECTION 2. Section 467.0301, Government Code, as added by
4949 this Act, applies only to an open meeting held on or after September
5050 1, 2019.
5151 SECTION 3. This Act takes effect September 1, 2017.
