66 AN ACT
77 relating to studies and reports on the prosecution of criminal
88 cases involving abusable synthetic substances.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. STUDY. (a) In this section:
1111 (1) "Abusable synthetic substance" has the meaning
1212 assigned by Section 484.001, Health and Safety Code.
1313 (2) "Department" means the Department of Public
1414 Safety.
1515 (b) The department shall conduct a study regarding the
1616 prosecution of criminal cases involving abusable synthetic
1717 substances.
1818 (c) The study under this section must address:
1919 (1) best practices in the prosecution of criminal
2020 cases involving abusable synthetic substances; and
2121 (2) the necessity of and funding for expert witnesses
2222 in investigations and prosecutions of criminal cases involving
2323 abusable synthetic substances.
2424 (d) The department shall compile a report of the results of
2525 the study, including any legislative recommendations, and submit
2626 the report to the legislature not later than January 1, 2019.
2727 SECTION 2. JOINT INTERIM COMMITTEE. (a) In this section,
2828 "abusable synthetic substance" has the meaning assigned by Section
2929 484.001, Health and Safety Code.
3030 (b) A joint interim committee is created to study, review,
3131 and report on the prosecution of criminal cases involving abusable
3232 synthetic substances.
3333 (c) The joint interim committee shall be composed of three
3434 senators appointed by the lieutenant governor and three members of
3535 the house of representatives appointed by the speaker of the house
3636 of representatives.
3737 (d) The lieutenant governor and speaker of the house of
3838 representatives shall each designate a co-chair from among the
3939 joint interim committee members.
4040 (e) The joint interim committee shall convene at the joint
4141 call of the co-chairs.
4242 (f) The joint interim committee has all other powers and
4343 duties provided to a special or select committee by the rules of the
4444 senate and house of representatives, by Subchapter B, Chapter 301,
4545 Government Code, and by policies of the senate and house committees
4646 on administration.
4747 (g) The joint interim committee shall evaluate:
4848 (1) the cost and efficacy of various methods to
4949 analyze abusable synthetic substances and test persons for the use
5050 of abusable synthetic substances;
5151 (2) public outreach and marketing campaigns that have
5252 the potential to reduce use of abusable synthetic substances; and
5353 (3) the availability and cost of appropriate treatment
5454 for individuals who use abusable synthetic substances.
5555 (h) The joint interim committee shall prepare a report of
5656 the findings of the committee that includes any proposed reforms.
5757 The committee shall submit the report to the legislature not later
5858 than January 1, 2019.
5959 (i) Not later than the 60th day after the effective date of
6060 this Act, the lieutenant governor and speaker of the house of
6161 representatives shall appoint the members of the joint interim
6262 committee in accordance with this section.
6363 (j) The joint interim committee created under this section
6464 is abolished January 2, 2019.
6565 SECTION 3. EXPIRATION. This Act expires January 2, 2019.
6666 SECTION 4. EFFECTIVE DATE. This Act takes effect
6767 immediately if it receives a vote of two-thirds of all the members
6868 elected to each house, as provided by Section 39, Article III, Texas
6969 Constitution. If this Act does not receive the vote necessary for
7070 immediate effect, this Act takes effect September 1, 2017.
