| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 8867.103, Special District Local Laws | |
| 11 | 11 | Code, is amended by amending Subsection (a) and adding Subsection | |
| 12 | 12 | (c) to read as follows: | |
| 13 | 13 | (a) The district may assess fees under Section 36.122(e) or | |
| 14 | 14 | 36.205(c), Water Code, in an annual amount not to exceed: | |
| 15 | 15 | (1) $1 per acre-foot of water used for agricultural | |
| 16 | 16 | use; [or] | |
| 17 | 17 | (2) 17 cents per thousand gallons of water used for any | |
| 18 | 18 | other purpose; or | |
| 19 | 19 | (3) notwithstanding any limitations on the amount of | |
| 20 | 20 | an export fee or surcharge authorized under Section 36.122(e), | |
| 21 | 21 | Water Code, 150 percent of the maximum commercial water rate | |
| 22 | 22 | charged by the City of Wichita Falls for groundwater exported from | |
| 23 | 23 | the district. | |
| 24 | 24 | (c) The district may use funds obtained from an export fee | |
| 25 | 25 | imposed under Subsection (a)(3) only to enhance: | |
| 26 | 26 | (1) aquifer monitoring, modeling, and data | |
| 27 | 27 | collection; and | |
| 28 | 28 | (2) research to advance the scientific understanding | |
| 29 | 29 | of the district's groundwater resources. | |
| 30 | 30 | SECTION 2. This Act takes effect September 1, 2017. |
