44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the punishment for the offense of criminal mischief
77 involving the death of a head of cattle or horses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 28.03(b), Penal Code, is amended to read
1010 as follows:
1111 (b) Except as provided by Subsections (f) and (h), an
1212 offense under this section is:
1313 (1) a Class C misdemeanor if:
1414 (A) the amount of pecuniary loss is less than
1515 $100; or
1616 (B) except as provided in Subdivision (3)(A) or
1717 (3)(B), it causes substantial inconvenience to others;
1818 (2) a Class B misdemeanor if the amount of pecuniary
1919 loss is $100 or more but less than $750;
2020 (3) a Class A misdemeanor if:
2121 (A) the amount of pecuniary loss is $750 or more
2222 but less than $2,500; or
2323 (B) the actor causes in whole or in part
2424 impairment or interruption of any public water supply, or causes to
2525 be diverted in whole, in part, or in any manner, including
2626 installation or removal of any device for any such purpose, any
2727 public water supply, regardless of the amount of the pecuniary
2828 loss;
2929 (4) a state jail felony if the amount of pecuniary loss
3030 is:
3131 (A) $2,500 or more but less than $30,000;
3232 (B) less than $2,500, if the property damaged or
3333 destroyed is a habitation and if the damage or destruction is caused
3434 by a firearm or explosive weapon;
3535 (C) less than $2,500, if the property was a fence
3636 used for the production or containment of:
3737 (i) cattle, bison, horses, sheep, swine,
3838 goats, exotic livestock, or exotic poultry; or
3939 (ii) game animals as that term is defined by
4040 Section 63.001, Parks and Wildlife Code; or
4141 (D) less than $30,000 and the actor causes wholly
4242 or partly impairment or interruption of public communications,
4343 public transportation, public gas or power supply, or other public
4444 service, or causes to be diverted wholly, partly, or in any manner,
4545 including installation or removal of any device for any such
4646 purpose, any public communications or public gas or power supply;
4747 (5) a felony of the third degree if:
4848 (A) the amount of the pecuniary loss is $30,000
4949 or more but less than $150,000; or
5050 (B) the actor's conduct, including the discharge
5151 of a firearm or weapon, resulted in the death of one or more head of
5252 cattle or horses;
5353 (6) a felony of the second degree if the amount of
5454 pecuniary loss is $150,000 or more but less than $300,000; or
5555 (7) a felony of the first degree if the amount of
5656 pecuniary loss is $300,000 or more.
5757 SECTION 2. The change in law made by this Act applies only
5858 to an offense committed on or after the effective date of this Act.
5959 An offense committed before the effective date of this Act is
6060 governed by the law in effect on the date the offense was committed,
6161 and the former law is continued in effect for that purpose. For
6262 purposes of this section, an offense was committed before the
6363 effective date of this Act if any element of the offense occurred
6464 before that date.
6565 SECTION 3. This Act takes effect September 1, 2017.
