77 relating to the use of alternative or substitute exit-level
88 assessment instruments to allow certain public school students to
99 receive a high school diploma.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.025(f), Education Code, is amended to
1212 read as follows:
1313 (f) A student who entered a grade above the ninth grade
1414 during the 2011-2012 school year or who repeated the ninth grade
1515 during the 2011-2012 school year may not receive a high school
1616 diploma unless the student [The commissioner shall by rule adopt a
1717 transition plan to implement the amendments made by Chapter 1312
1818 (S.B. No. 1031), Acts of the 80th Legislature, Regular Session,
1919 2007, replacing general subject assessment instruments
2020 administered at the high school level with end-of-course assessment
2121 instruments. The rules must provide for the end-of-course
2222 assessment instruments adopted under Section 39.023(c) to be
2323 administered beginning with students entering the ninth grade
2424 during the 2011-2012 school year. During the period under which the
2525 transition to end-of-course assessment instruments is made]:
2626 (1) has performed satisfactorily on each required
2727 assessment instrument administered under Section 39.023(c), as
2828 that section existed before September 1, 2007 [for students
2929 entering a grade above the ninth grade during the 2011-2012 school
3030 year, the commissioner shall retain, administer, and use for
3131 purposes of accreditation and other campus and district
3232 accountability measures under this chapter the assessment
3333 instruments required by Section 39.023(a) or (c), as that section
3434 existed before amendment by Chapter 1312 (S.B. No. 1031), Acts of
3535 the 80th Legislature, Regular Session, 2007]; or [and]
3636 (2) meets the exit-level requirements using an
3737 alternative assessment instrument adopted by the commissioner
3838 under Subsection (d) or an allowed substitute assessment instrument
3939 selected by the commissioner under Subsection (a-2), as added by
4040 Chapter 1036 (H.B. 1613), Acts of the 84th Legislature, Regular
4141 Session, 2015 [a student subject to Subdivision (1) may not receive
4242 a high school diploma unless the student has performed
4343 satisfactorily on each required assessment instrument administered
4444 under Section 39.023(c) as that section existed before amendment by
4545 Chapter 1312 (S.B. No. 1031), Acts of the 80th Legislature, Regular
4646 Session, 2007].
4747 SECTION 2. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2017.
