10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 39.025(f), Education Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | (f) A student who entered a grade above the ninth grade |
---|
14 | 14 | | during the 2011-2012 school year or who repeated the ninth grade |
---|
15 | 15 | | during the 2011-2012 school year may not receive a high school |
---|
16 | 16 | | diploma unless the student [The commissioner shall by rule adopt a |
---|
17 | 17 | | transition plan to implement the amendments made by Chapter 1312 |
---|
18 | 18 | | (S.B. No. 1031), Acts of the 80th Legislature, Regular Session, |
---|
19 | 19 | | 2007, replacing general subject assessment instruments |
---|
20 | 20 | | administered at the high school level with end-of-course assessment |
---|
21 | 21 | | instruments. The rules must provide for the end-of-course |
---|
22 | 22 | | assessment instruments adopted under Section 39.023(c) to be |
---|
23 | 23 | | administered beginning with students entering the ninth grade |
---|
24 | 24 | | during the 2011-2012 school year. During the period under which the |
---|
25 | 25 | | transition to end-of-course assessment instruments is made]: |
---|
26 | 26 | | (1) has performed satisfactorily on each required |
---|
27 | 27 | | assessment instrument administered under Section 39.023(c), as |
---|
28 | 28 | | that section existed before September 1, 2007 [for students |
---|
29 | 29 | | entering a grade above the ninth grade during the 2011-2012 school |
---|
30 | 30 | | year, the commissioner shall retain, administer, and use for |
---|
31 | 31 | | purposes of accreditation and other campus and district |
---|
32 | 32 | | accountability measures under this chapter the assessment |
---|
33 | 33 | | instruments required by Section 39.023(a) or (c), as that section |
---|
34 | 34 | | existed before amendment by Chapter 1312 (S.B. No. 1031), Acts of |
---|
35 | 35 | | the 80th Legislature, Regular Session, 2007]; or [and] |
---|
36 | 36 | | (2) meets the exit-level requirements using an |
---|
37 | 37 | | alternative assessment instrument adopted by the commissioner |
---|
38 | 38 | | under Subsection (d) or an allowed substitute assessment instrument |
---|
39 | 39 | | selected by the commissioner under Subsection (a-2), as added by |
---|
40 | 40 | | Chapter 1036 (H.B. 1613), Acts of the 84th Legislature, Regular |
---|
41 | 41 | | Session, 2015 [a student subject to Subdivision (1) may not receive |
---|
42 | 42 | | a high school diploma unless the student has performed |
---|
43 | 43 | | satisfactorily on each required assessment instrument administered |
---|
44 | 44 | | under Section 39.023(c) as that section existed before amendment by |
---|
45 | 45 | | Chapter 1312 (S.B. No. 1031), Acts of the 80th Legislature, Regular |
---|
46 | 46 | | Session, 2007]. |
---|
47 | 47 | | SECTION 2. This Act takes effect immediately if it receives |
---|
48 | 48 | | a vote of two-thirds of all the members elected to each house, as |
---|
49 | 49 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
50 | 50 | | Act does not receive the vote necessary for immediate effect, this |
---|
51 | 51 | | Act takes effect September 1, 2017. |
