66 AN ACT
77 relating to the establishment of a statewide system for stroke
88 response and treatment.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 93.001, Health and Safety Code, is
1111 amended by adding Subdivision (3) to read as follows:
1212 (3) "Stroke facility" has the meaning assigned by
1313 Section 773.202.
1414 SECTION 2. Chapter 93, Health and Safety Code, is amended by
1515 adding Subchapter C to read as follows:
1616 SUBCHAPTER C. STROKE RESPONSE AND TREATMENT
1717 Sec. 93.101. STATEWIDE SYSTEM FOR STROKE RESPONSE AND
1818 TREATMENT. The department, in coordination with the council and
1919 the stroke committee appointed under Section 773.203, shall develop
2020 and implement a statewide system for stroke response and treatment
2121 to achieve continuous improvement in the quality of care provided
2222 to stroke patients.
2323 Sec. 93.102. ELECTRONIC STROKE DATABASE; STATISTICAL DATA
2424 AND OTHER INFORMATION. (a) In implementing a statewide system for
2525 stroke response and treatment, the department shall create and
2626 maintain an electronic stroke database by:
2727 (1) compiling information and statistical data on
2828 stroke care that align with the stroke consensus performance
2929 measures developed and approved by the American Heart Association,
3030 the American Stroke Association, the federal Centers for Disease
3131 Control and Prevention, and The Joint Commission;
3232 (2) using the Get With The Guidelines-Stroke program
3333 maintained by the American Heart Association or a similar program
3434 by the American Stroke Association or another nationally recognized
3535 data system, provided the department determines the data system
3636 complies with acceptable patient confidentiality standards; and
3737 (3) coordinating with national voluntary health
3838 organizations involved in stroke care quality improvement to avoid
3939 duplication and redundancy in information compiled and maintained
4040 under this section.
4141 (b) To the extent possible, the department shall:
4242 (1) require comprehensive and primary stroke
4343 facilities, as determined by the department, to report statistical
4444 data consistent with nationally recognized guidelines on the
4545 treatment of patients who are confirmed to have suffered strokes
4646 and encourage emergency medical services providers licensed under
4747 Chapter 773 to participate;
4848 (2) encourage health care providers to share
4949 statistical data and other information about methods for improving
5050 the quality of care for stroke patients in this state;
5151 (3) facilitate the communication and analysis of
5252 statistical data and other information among health care providers
5353 who treat stroke patients; and
5454 (4) adopt evidence-based treatment guidelines on the
5555 transitioning of patients to hospital outpatient, physician
5656 office, and health clinic settings in their communities for
5757 continuing care after discharge from stroke facilities following
5858 acute treatment for stroke.
5959 Sec. 93.103. OVERSIGHT PROCESS AND PLAN FOR QUALITY
6060 IMPROVEMENT. The department shall establish an oversight process
6161 and implement a plan for achieving continuous quality improvement
6262 in the care provided under a statewide system for stroke response
6363 and treatment. The process and plan must:
6464 (1) analyze statistical data on stroke response and
6565 treatment contained in the electronic database established under
6666 Section 93.102;
6767 (2) identify potential interventions to improve
6868 stroke care in geographic regions of this state; and
6969 (3) provide recommendations to the department and the
7070 legislature for the improvement of stroke care and the delivery of
7171 stroke care in this state.
7272 Sec. 93.104. AVAILABILITY OF STATISTICAL DATA. The
7373 department shall make available all statistical data reported under
7474 Section 93.102 to other state agencies, local governmental
7575 entities, stroke facilities, and emergency medical services
7676 providers licensed under Chapter 773 that are responsible for
7777 managing and administering emergency medical services in this
7878 state.
7979 Sec. 93.105. REPORT. Not later than June 1 of each year,
8080 the department shall provide to the governor, lieutenant governor,
8181 speaker of the house of representatives, and standing committees of
8282 the senate and the house with primary jurisdiction over health
8383 matters a report summarizing the data collected under this section
8484 and any related findings and recommendations. The department shall
8585 post the report on the department's Internet website.
8686 Sec. 93.106. CONFIDENTIALITY. Information obtained under
8787 this subchapter that identifies a patient, or that is otherwise
8888 confidential under law, is excepted from required public disclosure
8989 under Chapter 552, Government Code, and may not be disclosed for any
9090 purpose.
9191 Sec. 93.107. RULEMAKING. The executive commissioner shall
9292 adopt rules necessary to implement this subchapter.
9393 SECTION 3. Not later than January 1, 2018:
9494 (1) the executive commissioner of the Health and Human
9595 Services Commission shall adopt the rules necessary to implement
9696 Subchapter C, Chapter 93, Health and Safety Code, as added by this
9797 Act; and
9898 (2) the Department of State Health Services shall
9999 establish the statewide system for stroke response and treatment as
100100 required by Subchapter C, Chapter 93, Health and Safety Code, as
101101 added by this Act.
102102 SECTION 4. This Act takes effect September 1, 2017.
