| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 552, Occupations Code, is amended by |
|---|
| 11 | 11 | | adding Section 552.0105 to read as follows: |
|---|
| 12 | 12 | | Sec. 552.0105. INTERNET BROADCAST AND ARCHIVE OF OPEN |
|---|
| 13 | 13 | | MEETINGS. (a) The board shall broadcast over the Internet live |
|---|
| 14 | 14 | | video and audio of each open meeting of the board. The board shall |
|---|
| 15 | 15 | | provide access to the broadcast on the board's Internet website. |
|---|
| 16 | 16 | | (b) Not later than the seventh day after the date an open |
|---|
| 17 | 17 | | meeting is broadcast under this section, the board shall make |
|---|
| 18 | 18 | | available through the board's Internet website archived video and |
|---|
| 19 | 19 | | audio of the open meeting. The board shall maintain the archived |
|---|
| 20 | 20 | | video and audio of the open meeting on the board's Internet website |
|---|
| 21 | 21 | | until the second anniversary of the date the archived video and |
|---|
| 22 | 22 | | audio was first made available on the website. |
|---|
| 23 | 23 | | (c) The board shall provide on the board's Internet website |
|---|
| 24 | 24 | | the same notice of the open meeting that the board is required to |
|---|
| 25 | 25 | | post under Subchapter C, Chapter 551, Government Code. The notice |
|---|
| 26 | 26 | | must be posted on the board's Internet website within the time |
|---|
| 27 | 27 | | required for posting notice under Subchapter C, Chapter 551, |
|---|
| 28 | 28 | | Government Code. |
|---|
| 29 | 29 | | (d) The board may use for an Internet broadcast of an open |
|---|
| 30 | 30 | | meeting of the board a room made available to the board on request |
|---|
| 31 | 31 | | in any state building, as that term is defined by Section 2165.301, |
|---|
| 32 | 32 | | Government Code. |
|---|
| 33 | 33 | | (e) The board is exempt from the requirements of this |
|---|
| 34 | 34 | | section to the extent a catastrophe, as defined by Section |
|---|
| 35 | 35 | | 551.0411, Government Code, or a technical breakdown prevents the |
|---|
| 36 | 36 | | board from complying with this section. Following the catastrophe |
|---|
| 37 | 37 | | or technical breakdown, the board shall make all reasonable efforts |
|---|
| 38 | 38 | | to make the required video and audio of the open meeting available |
|---|
| 39 | 39 | | in a timely manner. |
|---|
| 40 | 40 | | (f) The board shall consider contracting through |
|---|
| 41 | 41 | | competitive bidding with a private individual or entity to |
|---|
| 42 | 42 | | broadcast and archive an open meeting subject to this section to |
|---|
| 43 | 43 | | minimize the cost of complying with this section. |
|---|
| 44 | 44 | | SECTION 2. Section 552.0105, Occupations Code, as added by |
|---|
| 45 | 45 | | this Act, applies only to an open meeting held on or after September |
|---|
| 46 | 46 | | 1, 2019. |
|---|
| 47 | 47 | | SECTION 3. This Act takes effect September 1, 2017. |
