55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the practice of and the billing codes used by certain
88 mental health professionals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 502, Occupations Code, is
1111 amended by adding Section 502.0021 to read as follows:
1212 Sec. 502.0021. PRACTICE OF MARRIAGE AND FAMILY THERAPY.
1313 (a) In this section, "marriage and family therapy" means the
1414 provision of professional therapy services to individuals,
1515 families, or couples, alone or in groups, that involve applying
1616 family systems theories and techniques, including the evaluation
1717 and remediation of cognitive, affective, behavioral, or relational
1818 dysfunction in the context of marriage or family systems.
1919 (b) The practice of marriage and family therapy may include
2020 the use of the Diagnostic and Statistical Manual of Mental
2121 Disorders, the International Classification of Diseases, and other
2222 diagnostic classification systems and the use of billing codes in
2323 connection with those systems for assessment, evaluation,
2424 classification, treatment, and other activities by a person
2525 licensed under this chapter, in connection with a claim for payment
2626 or reimbursement from a health insurance policy issuer or other
2727 payor.
2828 (c) The practice of marriage and family therapy does not
2929 include prescribing medication, treating a physical disease, or
3030 providing any service outside the scope of practice of a licensed
3131 marriage and family therapist or licensed marriage and family
3232 therapist associate.
3333 SECTION 2. Section 503.003, Occupations Code, is amended by
3434 adding Subsections (d) and (e) to read as follows:
3535 (d) The practice of professional counseling may include the
3636 use of the Diagnostic and Statistical Manual of Mental Disorders,
3737 the International Classification of Diseases, and other diagnostic
3838 classification systems and the use of billing codes in connection
3939 with those systems for assessment, evaluation, classification,
4040 treatment, and other activities by a person licensed under this
4141 chapter, in connection with a claim for payment or reimbursement
4242 from a health insurance policy issuer or other payor.
4343 (e) The practice of professional counseling does not
4444 include prescribing medication, treating a physical disease, or
4545 providing any service outside the scope of practice of a licensed
4646 professional counselor.
4747 SECTION 3. Subchapter A, Chapter 504, Occupations Code, is
4848 amended by adding Section 504.0011 to read as follows:
4949 Sec. 504.0011. PRACTICE OF CHEMICAL DEPENDENCY COUNSELING.
5050 (a) The practice of chemical dependency counseling may include the
5151 use of the Diagnostic and Statistical Manual of Mental Disorders,
5252 the International Classification of Diseases, and other diagnostic
5353 classification systems and the use of billing codes in connection
5454 with those systems for assessment, evaluation, classification,
5555 treatment, and other activities by a person licensed under this
5656 chapter, in connection with a claim for payment or reimbursement
5757 from a health insurance policy issuer or other payor.
5858 (b) The practice of chemical dependency counseling does not
5959 include prescribing medication, treating a physical disease, or
6060 providing any service outside the scope of practice of a chemical
6161 dependency counselor.
6262 SECTION 4. Section 21.003(b), Education Code, is amended to
6363 read as follows:
6464 (b) Except as otherwise provided by this subsection, a
6565 person may not be employed by a school district as an audiologist,
6666 occupational therapist, physical therapist, physician, nurse,
6767 school psychologist, associate school psychologist, licensed
6868 professional counselor, marriage and family therapist, social
6969 worker, or speech language pathologist unless the person is
7070 licensed by the state agency that licenses that profession and may
7171 perform specific services within those professions for a school
7272 district only if the person holds the appropriate credential from
7373 the appropriate state agency. As long as a person employed by a
7474 district before September 1, 2011, to perform marriage and family
7575 therapy under Chapter 502 [, as defined by Section 502.002],
7676 Occupations Code, is employed by the same district, the person is
7777 not required to hold a license as a marriage and family therapist to
7878 perform marriage and family therapy with that district.
7979 SECTION 5. Section 502.002(6), Occupations Code, is
8080 repealed.
8181 SECTION 6. This Act takes effect immediately if it receives
8282 a vote of two-thirds of all the members elected to each house, as
8383 provided by Section 39, Article III, Texas Constitution. If this
8484 Act does not receive the vote necessary for immediate effect, this
8585 Act takes effect September 1, 2017.
