| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 8851.104(b), Special District Local Laws | |
| 11 | 11 | Code, is amended to read as follows: | |
| 12 | 12 | (b) In addition to other fees assessed by the district, the | |
| 13 | 13 | district may assess a fee on groundwater transferred out of the | |
| 14 | 14 | district in accordance with Section 36.122(e)(1) or (2), Water | |
| 15 | 15 | Code, in an amount not to exceed 10 percent of the amount of the fee | |
| 16 | 16 | assessed for the production of water for use in the district if a | |
| 17 | 17 | production fee is assessed. | |
| 18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
| 19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
| 20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
| 21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
| 22 | 22 | Act takes effect September 1, 2017. |
