7 | 7 | | relating to coverage for certain services related to maternal |

8 | 8 | | depression under the Medicaid and child health plan programs. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter D, Chapter 62, Health and Safety |
---|
11 | 11 | | Code, is amended by adding Section 62.1511 to read as follows: |
---|
12 | 12 | | Sec. 62.1511. COVERAGE FOR MATERNAL DEPRESSION SCREENING. |
---|
13 | 13 | | (a) In this section, "maternal depression" means depression of any |
---|
14 | 14 | | severity with postpartum onset. |
---|
15 | 15 | | (b) The covered services under the child health plan must |
---|
16 | 16 | | include a maternal depression screening for an enrollee's mother, |
---|
17 | 17 | | regardless of whether the mother is also an enrollee, that is |
---|
18 | 18 | | performed during a covered well-child or other office visit for the |
---|
19 | 19 | | enrollee that occurs before the enrollee's first birthday. |
---|
20 | 20 | | (c) The executive commissioner shall adopt rules necessary |
---|
21 | 21 | | to implement this section. The rules must be based on: |
---|
22 | 22 | | (1) clinical and empirical evidence concerning |
---|
23 | 23 | | maternal depression; and |
---|
24 | 24 | | (2) information provided by relevant physicians and |
---|
25 | 25 | | behavioral health organizations. |
---|
26 | 26 | | (d) The commission shall seek, accept, and spend any federal |
---|
27 | 27 | | funds that are available for the purposes of this section, |
---|
28 | 28 | | including priority funding authorized by Section 317L-1 of the |
---|
29 | 29 | | Public Health Service Act (42 U.S.C. Section 201 et seq.), as added |
---|
30 | 30 | | by the 21st Century Cures Act (Pub. L. No. 114-255). |
---|
31 | 31 | | SECTION 2. Subchapter B, Chapter 32, Human Resources Code, |
---|
32 | 32 | | is amended by adding Section 32.0561 to read as follows: |
---|
33 | 33 | | Sec. 32.0561. MATERNAL DEPRESSION SCREENING. (a) In this |
---|
34 | 34 | | section, "maternal depression" means depression of any severity |
---|
35 | 35 | | with postpartum onset. |
---|
36 | 36 | | (b) The commission shall provide medical assistance |
---|
37 | 37 | | reimbursement for a maternal depression screening for a recipient's |
---|
38 | 38 | | mother, regardless of whether the mother is also a recipient, that |
---|
39 | 39 | | is performed during a covered examination for the recipient under |
---|
40 | 40 | | the Texas Health Steps Comprehensive Care Program that occurs |
---|
41 | 41 | | before the recipient's first birthday. |
---|
42 | 42 | | (c) The executive commissioner shall adopt rules necessary |
---|
43 | 43 | | to implement this section. The rules must be based on: |
---|
44 | 44 | | (1) clinical and empirical evidence concerning |
---|
45 | 45 | | maternal depression; and |
---|
46 | 46 | | (2) information provided by relevant physicians and |
---|
47 | 47 | | behavioral health organizations. |
---|
48 | 48 | | (d) The commission shall seek, accept, and spend any federal |
---|
49 | 49 | | funds that are available for the purposes of this section, |
---|
50 | 50 | | including priority funding authorized by Section 317L-1 of the |
---|
51 | 51 | | Public Health Service Act (42 U.S.C. Section 201 et seq.), as added |

52 | 52 | | by the 21st Century Cures Act (Pub. L. No. 114-255). |

53 | 53 | | SECTION 3. If before implementing any provision of this Act |
---|
54 | 54 | | a state agency determines that a waiver or authorization from a |
---|
55 | 55 | | federal agency is necessary for implementation of that provision, |
---|
56 | 56 | | the agency affected by the provision shall request the waiver or |
---|
57 | 57 | | authorization and may delay implementing that provision until the |
---|
58 | 58 | | waiver or authorization is granted. |
---|
59 | 59 | | SECTION 4. This Act takes effect September 1, 2017. |
