66 AN ACT
77 relating to an exemption from motor carrier registration for
88 certain vehicles transporting household goods.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 643.002, Transportation Code, is amended
1111 to read as follows:
1212 Sec. 643.002. EXEMPTIONS. This chapter does not apply to:
1313 (1) motor carrier operations exempt from registration
1414 by the Unified Carrier Registration Act of 2005 (49 U.S.C. Section
1515 14504a) or a motor vehicle registered under the single state
1616 registration system established under federal law [49 U.S.C.
1717 Section 14504(c)] when operating exclusively in interstate or
1818 international commerce;
1919 (2) a motor vehicle registered as a cotton vehicle
2020 under Section 504.505;
2121 (3) a motor vehicle the department by rule exempts
2222 because the vehicle is subject to comparable registration and a
2323 comparable safety program administered by another governmental
2424 entity;
2525 (4) a motor vehicle used to transport passengers
2626 operated by an entity whose primary function is not the
2727 transportation of passengers, such as a vehicle operated by a
2828 hotel, day-care center, public or private school, nursing home, or
2929 similar organization;
3030 (5) a vehicle operating under a private carrier permit
3131 issued under Chapter 42, Alcoholic Beverage Code;
3232 (6) a vehicle operated by a governmental entity; [or]
3333 (7) a tow truck, as defined by Section 2308.002,
3434 Occupations Code; or
3535 (8) a passenger car or light truck, as those terms are
3636 defined by Section 541.201, that is:
3737 (A) transporting household goods; and
3838 (B) operating exclusively in intrastate
3939 commerce.
4040 SECTION 2. Section 643.051(b), Transportation Code, is
4141 amended to read as follows:
4242 (b) A motor carrier may not operate a vehicle to which this
4343 chapter applies[, regardless of size of the vehicle,] to transport
4444 household goods for compensation unless the carrier registers with
4545 the department under this subchapter.
4646 SECTION 3. This Act takes effect September 1, 2017.
