| 7 | 7 | | relating to an exemption from motor carrier registration for |

| 8 | 8 | | certain vehicles transporting household goods. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Section 643.002, Transportation Code, is amended |
|---|
| 11 | 11 | | to read as follows: |
|---|
| 12 | 12 | | Sec. 643.002. EXEMPTIONS. This chapter does not apply to: |
|---|
| 13 | 13 | | (1) motor carrier operations exempt from registration |
|---|
| 14 | 14 | | by the Unified Carrier Registration Act of 2005 (49 U.S.C. Section |
|---|
| 15 | 15 | | 14504a) or a motor vehicle registered under the single state |
|---|
| 16 | 16 | | registration system established under federal law [49 U.S.C. |
|---|
| 17 | 17 | | Section 14504(c)] when operating exclusively in interstate or |
|---|
| 18 | 18 | | international commerce; |
|---|
| 19 | 19 | | (2) a motor vehicle registered as a cotton vehicle |
|---|
| 20 | 20 | | under Section 504.505; |
|---|
| 21 | 21 | | (3) a motor vehicle the department by rule exempts |
|---|
| 22 | 22 | | because the vehicle is subject to comparable registration and a |
|---|
| 23 | 23 | | comparable safety program administered by another governmental |
|---|
| 24 | 24 | | entity; |
|---|
| 25 | 25 | | (4) a motor vehicle used to transport passengers |
|---|
| 26 | 26 | | operated by an entity whose primary function is not the |
|---|
| 27 | 27 | | transportation of passengers, such as a vehicle operated by a |
|---|
| 28 | 28 | | hotel, day-care center, public or private school, nursing home, or |
|---|
| 29 | 29 | | similar organization; |
|---|
| 30 | 30 | | (5) a vehicle operating under a private carrier permit |
|---|
| 31 | 31 | | issued under Chapter 42, Alcoholic Beverage Code; |
|---|
| 32 | 32 | | (6) a vehicle operated by a governmental entity; [or] |
|---|
| 33 | 33 | | (7) a tow truck, as defined by Section 2308.002, |
|---|
| 34 | 34 | | Occupations Code; or |
|---|
| 35 | 35 | | (8) a passenger car or light truck, as those terms are |
|---|
| 36 | 36 | | defined by Section 541.201, that is: |
|---|
| 37 | 37 | | (A) transporting household goods; and |
|---|
| 38 | 38 | | (B) operating exclusively in intrastate |
|---|
| 39 | 39 | | commerce. |
|---|
| 40 | 40 | | SECTION 2. Section 643.051(b), Transportation Code, is |
|---|
| 41 | 41 | | amended to read as follows: |
|---|
| 42 | 42 | | (b) A motor carrier may not operate a vehicle to which this |
|---|
| 43 | 43 | | chapter applies[, regardless of size of the vehicle,] to transport |
|---|
| 44 | 44 | | household goods for compensation unless the carrier registers with |
|---|
| 45 | 45 | | the department under this subchapter. |
|---|
| 46 | 46 | | SECTION 3. This Act takes effect September 1, 2017. |
