77 relating to prohibiting the use of automated traffic control
88 systems.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 542.2035, Transportation
1111 Code, is amended to read as follows:
1212 Sec. 542.2035. AUTOMATED TRAFFIC CONTROL SYSTEM PROHIBITED
1313 [LIMITATION ON MUNICIPALITIES].
1414 SECTION 2. Section 542.2035(a), Transportation Code, is
1515 amended to read as follows:
1616 (a) Notwithstanding any other law, this state, a local
1717 authority, a school district, a governmental agency that provides
1818 services to a school district, or an intermediate education agency
1919 [A municipality] may not implement or operate an automated traffic
2020 control system with respect to a highway or street under its
2121 jurisdiction for the purpose of enforcing compliance with posted
2222 speed limits. The attorney general shall enforce this subsection.
2323 SECTION 3. (a) Notwithstanding the changes in law made by
2424 this Act to Section 542.2035, Transportation Code, if before June
2525 1, 2017, this state, a local authority, a school district, a
2626 governmental agency that provides services to a school district, or
2727 an intermediate education agency had enacted an order, ordinance,
2828 or rule to implement an automated traffic control system and
2929 entered into a contract for the administration and enforcement of
3030 the system, the entity may continue to operate the system under that
3131 order, ordinance, or rule and under the terms of that contract until
3232 the expiration date specified in the contract as the contract
3333 existed on June 1, 2017.
3434 (b) Subsection (a) of this section does not apply to a
3535 contract for the administration and enforcement of an automated
3636 traffic control system before June 1, 2017, that explicitly
3737 authorizes termination of the contract on the basis of adverse
3838 state legislation.
3939 SECTION 4. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2017.
