9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. The heading to Section 542.2035, Transportation |
---|
11 | 11 | | Code, is amended to read as follows: |
---|
12 | 12 | | Sec. 542.2035. AUTOMATED TRAFFIC CONTROL SYSTEM PROHIBITED |
---|
13 | 13 | | [LIMITATION ON MUNICIPALITIES]. |
---|
14 | 14 | | SECTION 2. Section 542.2035(a), Transportation Code, is |
---|
15 | 15 | | amended to read as follows: |
---|
16 | 16 | | (a) Notwithstanding any other law, this state, a local |
---|
17 | 17 | | authority, a school district, a governmental agency that provides |
---|
18 | 18 | | services to a school district, or an intermediate education agency |
---|
19 | 19 | | [A municipality] may not implement or operate an automated traffic |
---|
20 | 20 | | control system with respect to a highway or street under its |
---|
21 | 21 | | jurisdiction for the purpose of enforcing compliance with posted |
---|
22 | 22 | | speed limits. The attorney general shall enforce this subsection. |
---|
23 | 23 | | SECTION 3. (a) Notwithstanding the changes in law made by |
---|
24 | 24 | | this Act to Section 542.2035, Transportation Code, if before June |
---|
25 | 25 | | 1, 2017, this state, a local authority, a school district, a |
---|
26 | 26 | | governmental agency that provides services to a school district, or |
---|
27 | 27 | | an intermediate education agency had enacted an order, ordinance, |
---|
28 | 28 | | or rule to implement an automated traffic control system and |
---|
29 | 29 | | entered into a contract for the administration and enforcement of |
---|
30 | 30 | | the system, the entity may continue to operate the system under that |
---|
31 | 31 | | order, ordinance, or rule and under the terms of that contract until |
---|
32 | 32 | | the expiration date specified in the contract as the contract |
---|
33 | 33 | | existed on June 1, 2017. |
---|
34 | 34 | | (b) Subsection (a) of this section does not apply to a |
---|
35 | 35 | | contract for the administration and enforcement of an automated |
---|
36 | 36 | | traffic control system before June 1, 2017, that explicitly |
---|
37 | 37 | | authorizes termination of the contract on the basis of adverse |
---|
38 | 38 | | state legislation. |
---|
39 | 39 | | SECTION 4. This Act takes effect immediately if it receives |
---|
40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
---|
41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
---|
43 | 43 | | Act takes effect September 1, 2017. |
