| 7 | 7 | | relating to the program to provide free or reduced-price meals to |
|---|
| 8 | 8 | | certain public school students. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Sections 33.901(a) and (b), Education Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) If at least 10 percent of the students enrolled in one or |
|---|
| 13 | 13 | | more schools in a school district or enrolled in an open-enrollment |
|---|
| 14 | 14 | | charter school are eligible for free or reduced-price breakfasts |
|---|
| 15 | 15 | | under the national school breakfast program provided for by the |
|---|
| 16 | 16 | | Child Nutrition Act of 1966 (42 U.S.C. Section 1773), the board of |
|---|
| 17 | 17 | | trustees of the school district or the governing body of the |
|---|
| 18 | 18 | | open-enrollment charter school may [shall either]: |
|---|
| 19 | 19 | | (1) participate in the national program and make the |
|---|
| 20 | 20 | | benefits of the national program available to all eligible students |
|---|
| 21 | 21 | | in the schools or school; or |
|---|
| 22 | 22 | | (2) develop and implement a locally funded program to |
|---|
| 23 | 23 | | provide free meals, including breakfast and lunch, to each student |
|---|
| 24 | 24 | | eligible for free meals under federal law and reduced-price meals, |
|---|
| 25 | 25 | | including breakfast and lunch, to each student eligible for |
|---|
| 26 | 26 | | reduced-price meals under federal law, provided that the reduced |
|---|
| 27 | 27 | | price may not exceed the maximum allowable rate under federal law. |
|---|
| 28 | 28 | | (b) A school district campus or an open-enrollment charter |
|---|
| 29 | 29 | | school participating in the national school breakfast program |
|---|
| 30 | 30 | | provided for by the Child Nutrition Act of 1966 (42 U.S.C. Section |
|---|
| 31 | 31 | | 1773) or providing a locally funded program in which 80 percent or |
|---|
| 32 | 32 | | more of the students qualify under the national program for a free |
|---|
| 33 | 33 | | or reduced-price breakfast may [shall] offer a free breakfast to |
|---|
| 34 | 34 | | each student. |
|---|
| 35 | 35 | | SECTION 2. Section 33.901(c), Education Code, is repealed. |
|---|
| 36 | 36 | | SECTION 3. This Act applies beginning with the 2017-2018 |
|---|
| 37 | 37 | | school year. |
|---|
| 38 | 38 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 39 | 39 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 40 | 40 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 41 | 41 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 42 | 42 | | Act takes effect September 1, 2017. |
