| 7 | 7 | | relating to the prosecution of the offense of operation of an |
|---|
| 8 | 8 | | unmanned aircraft over certain facilities. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 423.0045(a)(1), Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (1) "Critical infrastructure facility" means: |
|---|
| 13 | 13 | | (A) one of the following, if completely enclosed |
|---|
| 14 | 14 | | by a fence or other physical barrier that is obviously designed to |
|---|
| 15 | 15 | | exclude intruders, or if clearly marked with a sign or signs that |
|---|
| 16 | 16 | | are posted on the property, are reasonably likely to come to the |
|---|
| 17 | 17 | | attention of intruders, and indicate that entry is forbidden: |
|---|
| 18 | 18 | | (i) a petroleum or alumina refinery; |
|---|
| 19 | 19 | | (ii) an electrical power generating |
|---|
| 20 | 20 | | facility, substation, switching station, or electrical control |
|---|
| 21 | 21 | | center; |
|---|
| 22 | 22 | | (iii) a chemical, polymer, or rubber |
|---|
| 23 | 23 | | manufacturing facility; |
|---|
| 24 | 24 | | (iv) a water intake structure, water |
|---|
| 25 | 25 | | treatment facility, wastewater treatment plant, or pump station; |
|---|
| 26 | 26 | | (v) a natural gas compressor station; |
|---|
| 27 | 27 | | (vi) a liquid natural gas terminal or |
|---|
| 28 | 28 | | storage facility; |
|---|
| 29 | 29 | | (vii) a telecommunications central |
|---|
| 30 | 30 | | switching office; |
|---|
| 31 | 31 | | (viii) a port, railroad switching yard, |
|---|
| 32 | 32 | | trucking terminal, or other freight transportation facility; |
|---|
| 33 | 33 | | (ix) a gas processing plant, including a |
|---|
| 34 | 34 | | plant used in the processing, treatment, or fractionation of |
|---|
| 35 | 35 | | natural gas; |
|---|
| 36 | 36 | | (x) a transmission facility used by a |
|---|
| 37 | 37 | | federally licensed radio or television station; |
|---|
| 38 | 38 | | (xi) a steelmaking facility that uses an |
|---|
| 39 | 39 | | electric arc furnace to make steel; [or] |
|---|
| 40 | 40 | | (xii) a dam that is classified as a high |
|---|
| 41 | 41 | | hazard by the Texas Commission on Environmental Quality; or |
|---|
| 42 | 42 | | (xiii) a concentrated animal feeding |
|---|
| 43 | 43 | | operation, as defined by Section 26.048, Water Code; or |
|---|
| 44 | 44 | | (B) any portion of an aboveground oil, gas, or |
|---|
| 45 | 45 | | chemical pipeline that is enclosed by a fence or other physical |
|---|
| 46 | 46 | | barrier that is obviously designed to exclude intruders. |
|---|
| 47 | 47 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 48 | 48 | | to an offense committed on or after the effective date of this Act. |
|---|
| 49 | 49 | | An offense committed before the effective date of this Act is |
|---|
| 50 | 50 | | governed by the law in effect on the date the offense was committed, |
|---|
| 51 | 51 | | and the former law is continued in effect for that purpose. For |
|---|
| 52 | 52 | | purposes of this section, an offense was committed before the |
|---|
| 53 | 53 | | effective date of this Act if any element of the offense occurred |
|---|
| 54 | 54 | | before that date. |
|---|
| 55 | 55 | | SECTION 3. This Act takes effect September 1, 2017. |
