1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to the powers of the TexAmericas Center.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Section 3503.003(a), Special District Local Laws
1616 Code, is amended to read as follows:
1717 (a) The authority is created to:
1818 (1) accept title on approval by, and in coordination
1919 with, the governor to all or a portion of the property on, adjacent
2020 to, or related to the property described by Section 3503.004 from
2121 the United States;
2222 (2) promote the location and development of new
2323 businesses, industries, and commercial activities on or related to
2424 the property;
2525 (3) undertake a project the board considers necessary
2626 or incidental to the industrial, commercial, or business
2727 development, redevelopment, maintenance, and expansion of new or
2828 existing businesses on and for the property described by Section
2929 3503.004, including the acquisition, construction, operation,
3030 maintenance, repair, rehabilitation, replacement, improvement,
3131 extension, expansion, or enhancement of:
3232 (A) roads, bridges, and rights-of-way;
3333 (B) housing;
3434 (C) property;
3535 (D) police, fire, medical, cultural,
3636 educational, and research services, equipment, institutions, and
3737 resources;
3838 (E) other community support services;
3939 (F) flood control, water, wastewater treatment,
4040 natural gas, electricity, solid waste disposal, steam generation,
4141 communications, and all other utility facilities and services;
4242 (G) other infrastructure improvements; and
4343 (H) any other services or facilities acquired by
4444 the authority from the United States;
4545 (4) promote or support an active military base located
4646 in the same county as the authority to prevent closure or
4747 realignment of the base and attract new military missions to the
4848 base; [and]
4949 (5) exercise the powers granted to a conservation and
5050 reclamation district under Section 59, Article XVI, Texas
5151 Constitution; and
5252 (6) promote regional economic development and job
5353 creation inside the district's boundaries and outside of the
5454 district's boundaries in Bowie County and adjacent counties.
5555 SECTION 2. Subchapter C, Chapter 3503, Special District
5656 Local Laws Code, is amended by adding Section 3503.112 to read as
5757 follows:
5858 Sec. 3503.112. NONPROFIT CORPORATIONS FOR SPECIAL
5959 PROJECTS. (a) The authority may authorize by resolution the
6060 creation of a nonprofit corporation under the Business
6161 Organizations Code solely to undertake on behalf of the authority a
6262 project described by Section 3503.003(a)(3).
6363 (b) The board shall appoint the board of directors of each
6464 nonprofit corporation created under this section. A board member
6565 is not required to reside in the authority.
6666 (c) A board member or employee of the authority may
6767 simultaneously serve as a member of the board of directors of a
6868 nonprofit corporation. A person serving as a board member of the
6969 authority and of a nonprofit corporation created under this section
7070 may participate in all votes relating to the business of the
7171 authority or the corporation, regardless of any statutory
7272 prohibition.
7373 (d) The nonprofit corporation may not exercise the power of
7474 eminent domain.
7575 (e) A nonprofit corporation created under this section is
7676 subject to Chapters 551 and 552, Government Code.
7777 SECTION 3. This Act takes effect September 1, 2017.
