| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Section 3503.003(a), Special District Local Laws |
|---|
| 16 | 16 | | Code, is amended to read as follows: |
|---|
| 17 | 17 | | (a) The authority is created to: |
|---|
| 18 | 18 | | (1) accept title on approval by, and in coordination |
|---|
| 19 | 19 | | with, the governor to all or a portion of the property on, adjacent |
|---|
| 20 | 20 | | to, or related to the property described by Section 3503.004 from |
|---|
| 21 | 21 | | the United States; |
|---|
| 22 | 22 | | (2) promote the location and development of new |
|---|
| 23 | 23 | | businesses, industries, and commercial activities on or related to |
|---|
| 24 | 24 | | the property; |
|---|
| 25 | 25 | | (3) undertake a project the board considers necessary |
|---|
| 26 | 26 | | or incidental to the industrial, commercial, or business |
|---|
| 27 | 27 | | development, redevelopment, maintenance, and expansion of new or |
|---|
| 28 | 28 | | existing businesses on and for the property described by Section |
|---|
| 29 | 29 | | 3503.004, including the acquisition, construction, operation, |
|---|
| 30 | 30 | | maintenance, repair, rehabilitation, replacement, improvement, |
|---|
| 31 | 31 | | extension, expansion, or enhancement of: |
|---|
| 32 | 32 | | (A) roads, bridges, and rights-of-way; |
|---|
| 33 | 33 | | (B) housing; |
|---|
| 34 | 34 | | (C) property; |
|---|
| 35 | 35 | | (D) police, fire, medical, cultural, |
|---|
| 36 | 36 | | educational, and research services, equipment, institutions, and |
|---|
| 37 | 37 | | resources; |
|---|
| 38 | 38 | | (E) other community support services; |
|---|
| 39 | 39 | | (F) flood control, water, wastewater treatment, |
|---|
| 40 | 40 | | natural gas, electricity, solid waste disposal, steam generation, |
|---|
| 41 | 41 | | communications, and all other utility facilities and services; |
|---|
| 42 | 42 | | (G) other infrastructure improvements; and |
|---|
| 43 | 43 | | (H) any other services or facilities acquired by |
|---|
| 44 | 44 | | the authority from the United States; |
|---|
| 45 | 45 | | (4) promote or support an active military base located |
|---|
| 46 | 46 | | in the same county as the authority to prevent closure or |
|---|
| 47 | 47 | | realignment of the base and attract new military missions to the |
|---|
| 48 | 48 | | base; [and] |
|---|
| 49 | 49 | | (5) exercise the powers granted to a conservation and |
|---|
| 50 | 50 | | reclamation district under Section 59, Article XVI, Texas |
|---|
| 51 | 51 | | Constitution; and |
|---|
| 52 | 52 | | (6) promote regional economic development and job |
|---|
| 53 | 53 | | creation inside the district's boundaries and outside of the |
|---|
| 54 | 54 | | district's boundaries in Bowie County and adjacent counties. |

| 55 | 55 | | SECTION 2. Subchapter C, Chapter 3503, Special District |
|---|
| 56 | 56 | | Local Laws Code, is amended by adding Section 3503.112 to read as |
|---|
| 57 | 57 | | follows: |
|---|
| 58 | 58 | | Sec. 3503.112. NONPROFIT CORPORATIONS FOR SPECIAL |
|---|
| 59 | 59 | | PROJECTS. (a) The authority may authorize by resolution the |
|---|
| 60 | 60 | | creation of a nonprofit corporation under the Business |
|---|
| 61 | 61 | | Organizations Code solely to undertake on behalf of the authority a |
|---|
| 62 | 62 | | project described by Section 3503.003(a)(3). |
|---|
| 63 | 63 | | (b) The board shall appoint the board of directors of each |
|---|
| 64 | 64 | | nonprofit corporation created under this section. A board member |
|---|
| 65 | 65 | | is not required to reside in the authority. |
|---|
| 66 | 66 | | (c) A board member or employee of the authority may |
|---|
| 67 | 67 | | simultaneously serve as a member of the board of directors of a |
|---|
| 68 | 68 | | nonprofit corporation. A person serving as a board member of the |
|---|
| 69 | 69 | | authority and of a nonprofit corporation created under this section |
|---|
| 70 | 70 | | may participate in all votes relating to the business of the |
|---|
| 71 | 71 | | authority or the corporation, regardless of any statutory |
|---|
| 72 | 72 | | prohibition. |
|---|
| 73 | 73 | | (d) The nonprofit corporation may not exercise the power of |
|---|
| 74 | 74 | | eminent domain. |
|---|
| 75 | 75 | | (e) A nonprofit corporation created under this section is |
|---|
| 76 | 76 | | subject to Chapters 551 and 552, Government Code. |
|---|
| 77 | 77 | | SECTION 3. This Act takes effect September 1, 2017. |
