| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 341, Health and Safety Code, is amended |
|---|
| 11 | 11 | | by adding Subchapter G to read as follows: |
|---|
| 12 | 12 | | SUBCHAPTER G. SANITATION AND SAFETY IN BUILDINGS OPERATED BY |
|---|
| 13 | 13 | | GOVERNMENTAL ENTITIES |
|---|
| 14 | 14 | | Sec. 341.101. DIAPER CHANGING STATIONS. (a) In this |
|---|
| 15 | 15 | | section, "governmental entity" has the meaning assigned by Section |
|---|
| 16 | 16 | | 2051.041, Government Code. |
|---|
| 17 | 17 | | (b) A governmental entity that engages in or contracts for |
|---|
| 18 | 18 | | the construction or renovation of any building operated by the |
|---|
| 19 | 19 | | governmental entity that has one or more restrooms accessible to |
|---|
| 20 | 20 | | the general public shall provide a diaper changing station in at |
|---|
| 21 | 21 | | least one restroom designated for each gender or, if applicable, in |
|---|
| 22 | 22 | | at least one restroom not designated by gender. |
|---|
| 23 | 23 | | Sec. 341.102. SIGN REQUIREMENTS. A governmental entity |
|---|
| 24 | 24 | | required under Section 341.101 to provide a diaper changing station |
|---|
| 25 | 25 | | in a building operated by the entity shall post in a conspicuous |
|---|
| 26 | 26 | | place a sign with clear language indicating the location in the |
|---|
| 27 | 27 | | building of each restroom with a diaper changing station. |
|---|
| 28 | 28 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 29 | 29 | | the construction or renovation of a building operated by a |
|---|
| 30 | 30 | | governmental entity that has restrooms accessible to the general |
|---|
| 31 | 31 | | public that begins on or after the effective date of this Act. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect September 1, 2017. |
