| 7 | 7 | | relating to certain requirements for designation as a qualified |

| 8 | 8 | | business under the enterprise zone program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2303.401, Government Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | Sec. 2303.401. DEFINITIONS. In this subchapter: |
|---|
| 13 | 13 | | (1) "New permanent job" means a new employment |
|---|
| 14 | 14 | | position, regardless of title, that: |
|---|
| 15 | 15 | | (A) is created by a qualified business as |
|---|
| 16 | 16 | | described by Section 2303.402 at the qualified business site not |
|---|
| 17 | 17 | | earlier than the 90th day before the date the business's project or |
|---|
| 18 | 18 | | activity is designated as an enterprise project under this chapter; |
|---|
| 19 | 19 | | (B) is defined and certified by the qualified |
|---|
| 20 | 20 | | business as a full-time position and provides employment benefits, |
|---|
| 21 | 21 | | including health care benefits, [will provide or has provided for |
|---|
| 22 | 22 | | the duration of the project's designation period at least 1,820 |
|---|
| 23 | 23 | | hours of employment a year] to a qualified employee; and |
|---|
| 24 | 24 | | (C) will exist or has existed at the qualified |
|---|
| 25 | 25 | | business site for at least [the longer of]: |
|---|
| 26 | 26 | | (i) the duration of the project's |
|---|
| 27 | 27 | | designation period; or |
|---|
| 28 | 28 | | (ii) three years after the date on which a |
|---|
| 29 | 29 | | state benefit is received as authorized by this chapter. |
|---|
| 30 | 30 | | (2) "Retained job" means an employment position, |
|---|
| 31 | 31 | | regardless of title, [a job] that: |
|---|
| 32 | 32 | | (A) existed with a qualified business on the 91st |
|---|
| 33 | 33 | | day before the date the business's project or activity is |
|---|
| 34 | 34 | | designated as an enterprise project; |
|---|
| 35 | 35 | | (B) is defined and certified by the qualified |
|---|
| 36 | 36 | | business as a full-time position and provides employment benefits, |
|---|
| 37 | 37 | | including health care benefits, [has provided and will continue to |
|---|
| 38 | 38 | | provide employment] to a qualified employee [of at least 1,820 |
|---|
| 39 | 39 | | hours annually]; and |
|---|
| 40 | 40 | | (C) will be or has been an employment position |
|---|
| 41 | 41 | | for at least [the longer of]: |
|---|
| 42 | 42 | | (i) the duration of the project's |
|---|
| 43 | 43 | | designation period; or |
|---|
| 44 | 44 | | (ii) three years after the expiration date |
|---|
| 45 | 45 | | of the claim period for receipt of a state benefit authorized by |
|---|
| 46 | 46 | | this chapter. |
|---|
| 47 | 47 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 48 | 48 | | an application for an enterprise project designation under the |
|---|
| 49 | 49 | | enterprise zone program established under Chapter 2303, Government |
|---|
| 50 | 50 | | Code, as amended by this Act, that is submitted on or after the |
|---|
| 51 | 51 | | effective date of this Act. An application for an enterprise |
|---|
| 52 | 52 | | project designation under the enterprise zone program that is |
|---|
| 53 | 53 | | submitted before the effective date of this Act is governed by the |
|---|
| 54 | 54 | | law in effect on the date the application is submitted, and the |
|---|
| 55 | 55 | | former law is continued in effect for that purpose. |
|---|
| 56 | 56 | | SECTION 3. This Act takes effect September 1, 2017. |
