55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the criminal penalties for insider trading and other
88 misuse of official information by public servants.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.06, Penal Code, is amended by
1111 amending Subsection (e) and adding Subsection (g) to read as
1212 follows:
1313 (e) Except as provided by Subsection (f) or (g), an offense
1414 under this section is a felony of the third degree.
1515 (g) If the commission of an offense under this section
1616 results in a net pecuniary gain to the person committing the
1717 offense, the offense is:
1818 (1) a felony of the third degree if the net pecuniary
1919 gain is less than $100,000;
2020 (2) a felony of the second degree if the net pecuniary
2121 gain is $100,000 or more but less than $200,000; or
2222 (3) a felony of the first degree if the net pecuniary
2323 gain is $200,000 or more.
2424 SECTION 2. (a) The change in law made by this Act applies
2525 only to an offense committed on or after the effective date of this
2626 Act. For purposes of this section, an offense is committed before
2727 the effective date of this Act if any element of the offense occurs
2828 before the effective date.
2929 (b) An offense committed before the effective date of this
3030 Act is covered by the law in effect when the offense was committed,
3131 and the former law is continued in effect for that purpose.
3232 SECTION 3. This Act takes effect September 1, 2017.
