| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 84.009(a), Local Government Code, is | |
| 10 | 10 | amended to read as follows: | |
| 11 | 11 | (a) A county auditor may be removed from office and a | |
| 12 | 12 | successor appointed if, after due investigation by the district | |
| 13 | 13 | judges who appointed the auditor or by the office of the attorney | |
| 14 | 14 | general, it is proven that the auditor: | |
| 15 | 15 | (1) has committed official misconduct; or | |
| 16 | 16 | (2) is incompetent to faithfully discharge the duties | |
| 17 | 17 | of the office of county auditor. | |
| 18 | 18 | SECTION 2. This Act takes effect September 1, 2017. |
