66 AN ACT
77 relating to the use of municipal hotel occupancy tax revenue in
88 certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 351, Tax Code, is amended
1111 by adding Section 351.1072 to read as follows:
1212 Sec. 351.1072. ALLOCATION OF REVENUE: CERTAIN
1313 MUNICIPALITIES IN LARGE COUNTIES. (a) This section applies to a
1414 municipality that has a population of at least 1,660 but not more
1515 than 2,160 and that is located in a county that has a population of
1616 more than 425,000 but less than 500,000.
1717 (b) Notwithstanding any other provision of this chapter, a
1818 municipality to which this section applies may use revenue from the
1919 municipal hotel occupancy tax to directly enhance and promote
2020 tourism and the convention and hotel industry by acquiring sites
2121 for and constructing, improving, equipping, repairing, operating,
2222 and maintaining:
2323 (1) a sports-related venue or facility that is used or
2424 is planned for use for one or more professional or amateur sports
2525 events, including rodeos, and for:
2626 (A) livestock shows;
2727 (B) promotional events;
2828 (C) performing arts events;
2929 (D) community events; and
3030 (E) other civic or charitable events; or
3131 (2) a multiuse venue and related infrastructure, as
3232 defined by Section 334.001(3), Local Government Code.
3333 (c) A municipality to which this section applies that issues
3434 obligations secured by revenue derived from the tax authorized by
3535 this chapter for purposes described in this section may continue to
3636 use that revenue for those purposes for as long as the obligations
3737 are outstanding, regardless of whether the municipality ceases to
3838 meet the requirements of Subsection (a) while the obligations are
3939 outstanding.
4040 SECTION 2. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2017.
