9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 1369, Insurance Code, is | |
11 | 11 | amended by adding Section 1369.006 to read as follows: | |
12 | 12 | Sec. 1369.006. PRIOR AUTHORIZATION OF CERTAIN PRESCRIPTION | |
13 | 13 | DRUGS PROHIBITED. A health benefit plan that covers prescription | |
14 | 14 | eye drops or other topical medications used to treat a disease or | |
15 | 15 | condition of the eye or adnexa may not require that an enrollee | |
16 | 16 | receive prior authorization for the eye drops or other topical | |
17 | 17 | medications. | |
18 | 18 | SECTION 2. Section 1369.006, Insurance Code, as added by | |
19 | 19 | this Act, applies only to a health benefit plan delivered, issued | |
20 | 20 | for delivery, or renewed on or after January 1, 2018. A health | |
21 | 21 | benefit plan delivered, issued for delivery, or renewed before | |
22 | 22 | January 1, 2018, is governed by the law as it existed immediately | |
23 | 23 | before the effective date of this Act, and that law is continued in | |
24 | 24 | effect for that purpose. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2017. |
