77 relating to the authority to establish a customer assistance
88 program for certain municipally owned utilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter Z, Chapter 552, Local Government
1111 Code, is amended by adding Section 552.916 to read as follows:
1212 Sec. 552.916. CUSTOMER ASSISTANCE PROGRAM AUTHORITY FOR
1313 CERTAIN UTILITIES. (a) This section applies only to a board of
1414 trustees described by Section 1502.070(a)(2)(B), Government Code.
1515 (b) Notwithstanding any limitation provided by a home-rule
1616 charter or any other policy of a municipal governing body, a board
1717 of trustees has the exclusive authority to establish a bill payment
1818 assistance program for its utility system's customers:
1919 (1) who received notice of disconnection of service
2020 for nonpayment of bills; or
2121 (2) whom the utility determines are low-income
2222 customers.
2323 SECTION 2. This Act takes effect immediately if it receives
2424 a vote of two-thirds of all the members elected to each house, as
2525 provided by Section 39, Article III, Texas Constitution. If this
2626 Act does not receive the vote necessary for immediate effect, this
2727 Act takes effect September 1, 2017.
