9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter Z, Chapter 552, Local Government | |
11 | 11 | Code, is amended by adding Section 552.916 to read as follows: | |
12 | 12 | Sec. 552.916. CUSTOMER ASSISTANCE PROGRAM AUTHORITY FOR | |
13 | 13 | CERTAIN UTILITIES. (a) This section applies only to a board of | |
14 | 14 | trustees described by Section 1502.070(a)(2)(B), Government Code. | |
15 | 15 | (b) Notwithstanding any limitation provided by a home-rule | |
16 | 16 | charter or any other policy of a municipal governing body, a board | |
17 | 17 | of trustees has the exclusive authority to establish a bill payment | |
18 | 18 | assistance program for its utility system's customers: | |
19 | 19 | (1) who received notice of disconnection of service | |
20 | 20 | for nonpayment of bills; or | |
21 | 21 | (2) whom the utility determines are low-income | |
22 | 22 | customers. | |
23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
27 | 27 | Act takes effect September 1, 2017. |
