55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution of the offense of impersonating a
88 public servant.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.11(a), Penal Code, is amended to read
1111 as follows:
1212 (a) A person commits an offense if the person [he]:
1313 (1) impersonates a public servant with intent to
1414 induce another to submit to the person's [his] pretended official
1515 authority or to rely on the person's [his] pretended official acts;
1616 [or]
1717 (2) knowingly purports to exercise any function of a
1818 public servant or of a public office, including that of a judge and
1919 court, and the position or office through which the person [he]
2020 purports to exercise a function of a public servant or public office
2121 has no lawful existence under the constitution or laws of this state
2222 or of the United States; or
2323 (3) while serving as mediator or arbitrator, knowingly
2424 represents to another person that the actor is or was a member of
2525 the judiciary of this state, any other state, or the United States
2626 or uses any of the titles "judge," "justice," or "honorable," if the
2727 actor was not previously elected or appointed to be a member of the
2828 judiciary of this state, any other state, or the United States.
2929 SECTION 2. This Act takes effect September 1, 2017.
