| 7 | 7 | | relating to the prosecution of the offense of impersonating a |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 37.11(a), Penal Code, is amended to read |
|---|
| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (a) A person commits an offense if the person [he]: |
|---|
| 13 | 13 | | (1) impersonates a public servant with intent to |
|---|
| 14 | 14 | | induce another to submit to the person's [his] pretended official |
|---|
| 15 | 15 | | authority or to rely on the person's [his] pretended official acts; |
|---|
| 16 | 16 | | [or] |
|---|
| 17 | 17 | | (2) knowingly purports to exercise any function of a |
|---|
| 18 | 18 | | public servant or of a public office, including that of a judge and |
|---|
| 19 | 19 | | court, and the position or office through which the person [he] |
|---|
| 20 | 20 | | purports to exercise a function of a public servant or public office |
|---|
| 21 | 21 | | has no lawful existence under the constitution or laws of this state |
|---|
| 22 | 22 | | or of the United States; or |
|---|
| 23 | 23 | | (3) while serving as mediator or arbitrator, knowingly |
|---|
| 24 | 24 | | represents to another person that the actor is or was a member of |
|---|
| 25 | 25 | | the judiciary of this state, any other state, or the United States |
|---|
| 26 | 26 | | or uses any of the titles "judge," "justice," or "honorable," if the |
|---|
| 27 | 27 | | actor was not previously elected or appointed to be a member of the |
|---|
| 28 | 28 | | judiciary of this state, any other state, or the United States. |

| 29 | 29 | | SECTION 2. This Act takes effect September 1, 2017. |
