5	7		relating to the Gulf Coast Waste Disposal Authority.
6	8		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	9		SECTION 1. Section 1.02, Chapter 409, Acts of the 61st
8	10		Legislature, Regular Session, 1969, is amended to read as follows:
9	11		Sec. 1.02. FINDINGS AND DECLARATION OF POLICY. It is hereby
10	12		found and declared that the quality of waters in Chambers,
11	13		Galveston, and Harris Counties is materially affected by the
12	14		disposal of wastes throughout those counties; that regional
13	15		approaches to studying water pollution in these counties, to
14	16		planning corrective and preventive measures, to providing
15	17		coordinated facilities for waste disposal, and to regulating waste
16	18		disposal would be far more effective than efforts on a county-wide,
17	19		city-wide, or smaller scale; that solid wastes, as well as other
18	20		kinds of waste, may impair water quality by seepage, drainage, and
19	21		otherwise; that creation of the Gulf Coast [Waste Disposal]
20	22		Authority would advance the established policy of the state to
21	23		maintain the quality of the waters in the state consistent with the
22	24		public health and public enjoyment thereof, the propagation and
23	25		protection of terrestrial and aquatic life, the operation of
24	26		existing industries, and the economic development of the state; and
25	27		that impending shortage of water in the district for beneficial
26	28		uses requires that all reasonable measures be taken to prevent and
27	29		abate water pollution, and to reclaim polluted water for beneficial
28	30		uses.
29	31		SECTION 2. Section 1.03(a)(1), Chapter 409, Acts of the
30	32		61st Legislature, Regular Session, 1969, is amended to read as
31	33		follows:
32	34		(1) "Authority" means the Gulf Coast [Waste Disposal]
33	35		Authority created by this Act.
34	36		SECTION 3. Section 2.01, Chapter 409, Acts of the 61st
35	37		Legislature, Regular Session, 1969, is amended to read as follows:
36	38		Section 2.01. CREATION OF AUTHORITY. There is hereby
37	39		created, pursuant to Article XVI, Section 59, of the Texas
38	40		Constitution, a conservation and reclamation district to be known
39	41		as the Gulf Coast [Waste Disposal] Authority, which shall be a
40	42		governmental agency and body politic and corporate of the State of
41	43		Texas. A confirmation election shall not be necessary.
42	44		SECTION 4. Chapter 409, Acts of the 61st Legislature,
43	45		Regular Session, 1969, is amended by adding Section 2.015 to read as
44	46		follows:
45	47		Sec. 2.015. NAME CHANGE. A reference in law to the Gulf
46	48		Coast Waste Disposal Authority means the Gulf Coast Authority.
47	49		SECTION 5. Section 8104.006, Special District Local Laws
48	50		Code, is amended to read as follows:
49	51		Sec. 8104.006. RELATIONSHIP TO GULF COAST [WASTE DISPOSAL]
50	52		AUTHORITY. The rights, powers, privileges, and functions granted
51	53		to the authority under this chapter are subject to the powers
52	54		granted to the Gulf Coast [Waste Disposal] Authority in Chapter
53	55		409, Acts of the 61st Legislature, Regular Session, 1969 (Article
54	56		7621d-2, Vernon's Texas Civil Statutes), to provide disposal
55	57		systems.
56	58		SECTION 6. Section 8104.205, Special District Local Laws
57	59		Code, is amended to read as follows:
58	60		Sec. 8104.205. CONSENT REQUIRED FOR WASTE TREATMENT AND
59	61		DISPOSAL FACILITIES. Before acquiring or constructing a waste
60	62		treatment or disposal facility, the authority must obtain the
61	63		consent of the:
62	64		(1) Gulf Coast [Waste Disposal] Authority; or
63	65		(2) Texas Commission on Environmental Quality, if the
64	66		consent of the Gulf Coast [Waste Disposal] Authority is
65	67		unreasonably withheld or delayed.
66	68		SECTION 7. This Act takes effect immediately if it receives
67	69		a vote of two-thirds of all the members elected to each house, as
68	70		provided by Section 39, Article III, Texas Constitution. If this
69	71		Act does not receive the vote necessary for immediate effect, this
70	72		Act takes effect September 1, 2017.
