68 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
79 SECTION 1. Section 1.02, Chapter 409, Acts of the 61st
810 Legislature, Regular Session, 1969, is amended to read as follows:
911 Sec. 1.02. FINDINGS AND DECLARATION OF POLICY. It is hereby
1012 found and declared that the quality of waters in Chambers,
1113 Galveston, and Harris Counties is materially affected by the
1214 disposal of wastes throughout those counties; that regional
1315 approaches to studying water pollution in these counties, to
1416 planning corrective and preventive measures, to providing
1517 coordinated facilities for waste disposal, and to regulating waste
1618 disposal would be far more effective than efforts on a county-wide,
1719 city-wide, or smaller scale; that solid wastes, as well as other
1820 kinds of waste, may impair water quality by seepage, drainage, and
1921 otherwise; that creation of the Gulf Coast [Waste Disposal]
2022 Authority would advance the established policy of the state to
2123 maintain the quality of the waters in the state consistent with the
2224 public health and public enjoyment thereof, the propagation and
2325 protection of terrestrial and aquatic life, the operation of
2426 existing industries, and the economic development of the state; and
2527 that impending shortage of water in the district for beneficial
2628 uses requires that all reasonable measures be taken to prevent and
2729 abate water pollution, and to reclaim polluted water for beneficial
2830 uses.
2931 SECTION 2. Section 1.03(a)(1), Chapter 409, Acts of the
3032 61st Legislature, Regular Session, 1969, is amended to read as
3133 follows:
3234 (1) "Authority" means the Gulf Coast [Waste Disposal]
3335 Authority created by this Act.
3436 SECTION 3. Section 2.01, Chapter 409, Acts of the 61st
3537 Legislature, Regular Session, 1969, is amended to read as follows:
3638 Section 2.01. CREATION OF AUTHORITY. There is hereby
3739 created, pursuant to Article XVI, Section 59, of the Texas
3840 Constitution, a conservation and reclamation district to be known
3941 as the Gulf Coast [Waste Disposal] Authority, which shall be a
4042 governmental agency and body politic and corporate of the State of
4143 Texas. A confirmation election shall not be necessary.
4244 SECTION 4. Chapter 409, Acts of the 61st Legislature,
4345 Regular Session, 1969, is amended by adding Section 2.015 to read as
4446 follows:
4547 Sec. 2.015. NAME CHANGE. A reference in law to the Gulf
4648 Coast Waste Disposal Authority means the Gulf Coast Authority.
4749 SECTION 5. Section 8104.006, Special District Local Laws
4850 Code, is amended to read as follows:
4951 Sec. 8104.006. RELATIONSHIP TO GULF COAST [WASTE DISPOSAL]
5052 AUTHORITY. The rights, powers, privileges, and functions granted
5153 to the authority under this chapter are subject to the powers
5254 granted to the Gulf Coast [Waste Disposal] Authority in Chapter
5355 409, Acts of the 61st Legislature, Regular Session, 1969 (Article
5456 7621d-2, Vernon's Texas Civil Statutes), to provide disposal
5557 systems.
5658 SECTION 6. Section 8104.205, Special District Local Laws
5759 Code, is amended to read as follows:
5860 Sec. 8104.205. CONSENT REQUIRED FOR WASTE TREATMENT AND
5961 DISPOSAL FACILITIES. Before acquiring or constructing a waste
6062 treatment or disposal facility, the authority must obtain the
6163 consent of the:
6264 (1) Gulf Coast [Waste Disposal] Authority; or
6365 (2) Texas Commission on Environmental Quality, if the
6466 consent of the Gulf Coast [Waste Disposal] Authority is
6567 unreasonably withheld or delayed.
6668 SECTION 7. This Act takes effect immediately if it receives
6769 a vote of two-thirds of all the members elected to each house, as
6870 provided by Section 39, Article III, Texas Constitution. If this
6971 Act does not receive the vote necessary for immediate effect, this
7072 Act takes effect September 1, 2017.
