| 8 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 11 | SECTION 1. Section 1953.052(a), Insurance Code, is amended | |
| 10 | 12 | to read as follows: | |
| 11 | 13 | (a) An insurer described by Section 1952.001 shall assess a | |
| 12 | 14 | premium surcharge in an amount as stated in the insurer's rating | |
| 13 | 15 | plan [prescribed by the department] against an insured for no more | |
| 14 | 16 | than three years immediately following the date the insured is | |
| 15 | 17 | convicted of: | |
| 16 | 18 | (1) an offense relating to the operating of a motor | |
| 17 | 19 | vehicle while intoxicated in violation of Section 49.04 or 49.07, | |
| 18 | 20 | Penal Code; or | |
| 19 | 21 | (2) an offense under Section 49.08, Penal Code. | |
| 20 | 22 | SECTION 2. This Act takes effect September 1, 2017. | |
