46 AN ACT
57 relating to the premium surcharge certain automobile insurers are
68 required to assess against an insured convicted of certain
79 offenses.
810 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
911 SECTION 1. Section 1953.052(a), Insurance Code, is amended
1012 to read as follows:
1113 (a) An insurer described by Section 1952.001 shall assess a
1214 premium surcharge in an amount as stated in the insurer's rating
1315 plan [prescribed by the department] against an insured for no more
1416 than three years immediately following the date the insured is
1517 convicted of:
1618 (1) an offense relating to the operating of a motor
1719 vehicle while intoxicated in violation of Section 49.04 or 49.07,
1820 Penal Code; or
1921 (2) an offense under Section 49.08, Penal Code.
2022 SECTION 2. This Act takes effect September 1, 2017.
