46 AN ACT
57 relating to preauthorization and concurrent review of certain
68 health care services under the workers' compensation system.
79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Section 413.014, Labor Code, is amended by
911 amending Subsection (c) and adding Subsection (c-1) to read as
1012 follows:
1113 (c) The commissioner's rules adopted under this section
1214 must provide that preauthorization and concurrent review are
1315 required at a minimum for:
1416 (1) spinal surgery, as provided by Section 408.026;
1517 (2) work-hardening or work-conditioning services
1618 [provided by a health care facility that is not credentialed by an
1719 organization recognized by commissioner rules];
1820 (3) inpatient hospitalization, including any
1921 procedure and length of stay;
2022 (4) physical and occupational therapy;
2123 (5) outpatient or ambulatory surgical services, as
2224 defined by commissioner rule; and
2325 (6) any investigational or experimental services or
2426 devices.
2527 (c-1) Notwithstanding Subsection (c)(2), the commissioner
2628 by rule may exempt from preauthorization and concurrent review
2729 work-hardening or work-conditioning services provided by a health
2830 care facility that is credentialed by an organization designated by
2931 commissioner rule.
3032 SECTION 2. The change in law made by this Act applies only
3133 to health care services provided on or after the effective date of
3234 this Act in conjunction with a claim for workers' compensation
3335 benefits, regardless of the date on which the compensable injury
3436 that is the basis of the claim occurred.
3537 SECTION 3. This Act takes effect September 1, 2017.
