| 6 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 7 | 9 | | SECTION 1. Subchapter A, Chapter 1601, Occupations Code, is |
|---|
| 8 | 10 | | amended by adding Section 1601.0025 to read as follows: |

| 9 | 11 | | Sec. 1601.0025. SERVICES NOT CONSTITUTING BARBERING. |
|---|
| 10 | 12 | | Notwithstanding Section 1601.002, "barbering," "practicing |
|---|
| 11 | 13 | | barbering," and "practice of barbering" do not include threading, |
|---|
| 12 | 14 | | which involves removing unwanted hair from a person by using a piece |
|---|
| 13 | 15 | | of thread that is looped around the hair and pulled to remove the |
|---|
| 14 | 16 | | hair and includes the incidental trimming of eyebrow hair. |
|---|
| 15 | 17 | | SECTION 2. Section 1602.002(a), Occupations Code, is |
|---|
| 16 | 18 | | amended to read as follows: |
|---|
| 17 | 19 | | (a) In this chapter, "cosmetology" means the practice of |
|---|
| 18 | 20 | | performing or offering to perform for compensation any of the |
|---|
| 19 | 21 | | following services: |
|---|
| 20 | 22 | | (1) treating a person's hair by: |
|---|
| 21 | 23 | | (A) providing any method of treatment as a |
|---|
| 22 | 24 | | primary service, including arranging, beautifying, bleaching, |
|---|
| 23 | 25 | | cleansing, coloring, cutting, dressing, dyeing, processing, |
|---|
| 24 | 26 | | shampooing, shaping, singeing, straightening, styling, tinting, or |
|---|
| 25 | 27 | | waving; |
|---|
| 26 | 28 | | (B) providing a necessary service that is |
|---|
| 27 | 29 | | preparatory or ancillary to a service under Paragraph (A), |
|---|
| 28 | 30 | | including bobbing, clipping, cutting, or trimming a person's hair |
|---|
| 29 | 31 | | or shaving a person's neck with a safety razor; or |
|---|
| 30 | 32 | | (C) cutting the person's hair as a separate and |
|---|
| 31 | 33 | | independent service for which a charge is directly or indirectly |
|---|
| 32 | 34 | | made separately from charges for any other service; |
|---|
| 33 | 35 | | (2) shampooing and conditioning a person's hair; |
|---|
| 34 | 36 | | (3) servicing a person's wig or artificial hairpiece |
|---|
| 35 | 37 | | on a person's head or on a block after the initial retail sale and |
|---|
| 36 | 38 | | servicing in any manner listed in Subdivision (1); |
|---|
| 37 | 39 | | (4) treating a person's mustache or beard by |
|---|
| 38 | 40 | | arranging, beautifying, coloring, processing, styling, trimming, |
|---|
| 39 | 41 | | or shaving with a safety razor; |
|---|
| 40 | 42 | | (5) cleansing, stimulating, or massaging a person's |
|---|
| 41 | 43 | | scalp, face, neck, or arms: |
|---|
| 42 | 44 | | (A) by hand or by using a device, apparatus, or |
|---|
| 43 | 45 | | appliance; and |
|---|
| 44 | 46 | | (B) with or without the use of any cosmetic |
|---|
| 45 | 47 | | preparation, antiseptic, tonic, lotion, or cream; |
|---|
| 46 | 48 | | (6) beautifying a person's face, neck, or arms using a |
|---|
| 47 | 49 | | cosmetic preparation, antiseptic, tonic, lotion, powder, oil, |
|---|
| 48 | 50 | | clay, cream, or appliance; |
|---|
| 49 | 51 | | (7) administering facial treatments; |
|---|
| 50 | 52 | | (8) removing superfluous hair from a person's body |
|---|
| 51 | 53 | | using depilatories, preparations or chemicals, tweezers, or other |
|---|
| 52 | 54 | | devices or appliances of any kind or description [tweezing |
|---|
| 53 | 55 | | techniques]; |
|---|
| 54 | 56 | | (9) treating a person's nails by: |
|---|
| 55 | 57 | | (A) cutting, trimming, polishing, tinting, |
|---|
| 56 | 58 | | coloring, cleansing, or manicuring; or |
|---|
| 57 | 59 | | (B) attaching false nails; |
|---|
| 58 | 60 | | (10) massaging, cleansing, treating, or beautifying a |
|---|
| 59 | 61 | | person's hands or feet; |
|---|
| 60 | 62 | | (11) applying semipermanent, thread-like extensions |
|---|
| 61 | 63 | | composed of single fibers to a person's eyelashes; or |
|---|
| 62 | 64 | | (12) weaving a person's hair. |

| 63 | 65 | | SECTION 3. Subchapter A, Chapter 1602, Occupations Code, is |

| 64 | 66 | | amended by adding Section 1602.0025 to read as follows: |
