55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to filing fees imposed in civil cases in Hidalgo County,
88 Cameron County, and Willacy County.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 51.711, Government Code, is amended by
1111 amending Subsections (b), (f), (g), (h), and (i) and adding
1212 Subsection (e-1) to read as follows:
1313 (b) Except as otherwise provided by this section and in
1414 addition to all other fees authorized or required by other law, the
1515 clerk of a court shall collect a filing fee of not more than $20 in
1616 each civil case filed in the court to be used:
1717 (1) for the construction, renovation, or improvement
1818 of the facilities that house the Hidalgo County or Cameron County
1919 civil courts; and
2020 (2) to pay the principal of, interest on, and costs of
2121 issuance of bonds issued for the construction, renovation, or
2222 improvement of the facilities that house the Hidalgo County or
2323 Cameron County civil courts.
2424 (e-1) If Hidalgo County or Cameron County has adopted a
2525 resolution authorizing a fee as provided by Subsection (e) that is
2626 abolished on or before October 1, 2030, the county may:
2727 (1) adopt a resolution authorizing the fee adopted
2828 under Subsection (e) to continue until October 1, 2045;
2929 (2) adopt a resolution providing that the county must
3030 continue to spend one dollar for the construction, renovation, or
3131 improvement of the court facilities for each dollar spent from the
3232 special account dedicated to that purpose; and
3333 (3) file the resolution adopted under this subsection
3434 with the county treasurer or with any other official who discharges
3535 the duties commonly assigned to the county treasurer not later than
3636 September 1 immediately preceding the first 12-month period during
3737 which the county has authorized the fee to continue to be collected
3838 through October 1, 2045.
3939 (f) A resolution adopted under Subsection (e) continues
4040 from year to year until October 1, 2030, if adopted under Subsection
4141 (e) before September 1, 2017, or October 1, 2045, if adopted under
4242 Subsection (e) on or after September 1, 2017, allowing the county to
4343 collect fees under the terms of this section until the resolution is
4444 rescinded. A resolution adopted under Subsection (e-1) continues
4545 from year to year until October 1, 2045, allowing the county to
4646 collect fees under the terms of this section until the resolution is
4747 rescinded.
4848 (g) The commissioners court of the county collecting the fee
4949 may rescind a resolution adopted under Subsection (e) or (e-1) by
5050 adopting a resolution rescinding the resolution and submitting the
5151 rescission resolution to the county treasurer or to any other
5252 official who discharges the duties commonly assigned to the county
5353 treasurer not later than September 1 preceding the beginning of the
5454 first day of the county fiscal year. The commissioners court may
5555 adopt an additional resolution in the manner provided by Subsection
5656 (e) after rescinding a previous resolution [under that subsection].
5757 (h) A fee established under a particular resolution is
5858 abolished on the earlier of:
5959 (1) the date a resolution adopted under Subsection (e)
6060 or (e-1) is rescinded as provided by Subsection (g); [or]
6161 (2) October 1, 2030, if adopted under Subsection (e)
6262 before September 1, 2017;
6363 (3) October 1, 2045, if adopted under Subsection (e)
6464 on or after September 1, 2017; or
6565 (4) October 1, 2045, if adopted under Subsection
6666 (e-1).
6767 (i) Hidalgo County or Cameron County may make the required
6868 expenditure described by Subsection (e)(2) or (e-1)(2) at any time,
6969 regardless of when the expenditure from the special account occurs.
7070 SECTION 2. Subchapter H, Chapter 51, Government Code, is
7171 amended by adding Section 51.713 to read as follows:
7272 Sec. 51.713. ADDITIONAL FILING FEE FOR CIVIL CASES IN
7373 WILLACY COUNTY. (a) This section applies only to district courts,
7474 the constitutional county court, and justice courts in Willacy
7575 County.
7676 (b) Except as otherwise provided by this section and in
7777 addition to all other fees authorized or required by other law, the
7878 clerk of a court shall collect a filing fee of not more than $20 in
7979 each civil case filed in the court to be used:
8080 (1) for the construction, renovation, or improvement
8181 of the facilities that house the Willacy County civil courts; and
8282 (2) to pay the principal of, interest on, and costs of
8383 issuance of bonds issued for the construction, renovation, or
8484 improvement of the facilities that house the Willacy County civil
8585 courts.
8686 (c) Court fees due under this section shall be collected in
8787 the same manner as other fees, fines, or costs are collected in the
8888 case.
8989 (d) The clerk shall send the fees collected under this
9090 section to the county treasurer or to any other official who
9191 discharges the duties commonly assigned to the county treasurer at
9292 least as frequently as monthly. The treasurer or other official
9393 shall deposit the fees in a special account in the county treasury
9494 dedicated to:
9595 (1) the construction, renovation, or improvement of
9696 the facilities that house the Willacy County civil courts; and
9797 (2) pay the principal of, interest on, and costs of
9898 issuance of bonds issued for the construction, renovation, or
9999 improvement of the facilities that house the Willacy County civil
100100 courts.
101101 (e) This section applies only to fees for a 12-month period
102102 beginning October 1, if the commissioners court:
103103 (1) adopts a resolution authorizing a fee of not more
104104 than $20;
105105 (2) adopts a resolution requiring the county to spend
106106 one dollar for the construction, renovation, or improvement of the
107107 court facilities or to pay the principal of, interest on, and costs
108108 of issuance of bonds issued for the construction of court
109109 facilities for each dollar spent from the special account dedicated
110110 to that purpose; and
111111 (3) files the resolutions with the county treasurer or
112112 with any other official who discharges the duties commonly assigned
113113 to the county treasurer not later than September 1 immediately
114114 preceding the first 12-month period during which the fees are to be
115115 collected.
116116 (f) A resolution adopted under Subsection (e) continues
117117 from year to year until October 1, 2045, allowing the county to
118118 collect fees under the terms of this section until the resolution is
119119 rescinded.
120120 (g) The commissioners court may rescind a resolution
121121 adopted under Subsection (e) by adopting a resolution rescinding
122122 the resolution and submitting the rescission resolution to the
123123 county treasurer or to any other official who discharges the duties
124124 commonly assigned to the county treasurer not later than September
125125 1 preceding the beginning of the first day of the county fiscal
126126 year. The commissioners court may adopt an additional resolution
127127 in the manner provided by Subsection (e) after rescinding a
128128 previous resolution under that subsection.
129129 (h) A fee established under a particular resolution is
130130 abolished on the earlier of:
131131 (1) the date a resolution adopted under Subsection (e)
132132 is rescinded as provided by Subsection (g); or
133133 (2) October 1, 2045.
134134 (i) The county may make the required expenditure described
135135 by Subsection (e)(2) at any time, regardless of when the
136136 expenditure from the special account occurs.
137137 SECTION 3. Subchapter D, Chapter 101, Government Code, is
138138 amended by adding Sections 101.061194 and 101.061195 to read as
139139 follows:
140140 Sec. 101.061194. ADDITIONAL DISTRICT COURT FEES FOR COURT
141141 FACILITIES: GOVERNMENT CODE. The clerk of a district court in
142142 Hidalgo County and the clerk of a district court in Cameron County
143143 shall collect an additional filing fee of not more than $20 under
144144 Section 51.711, Government Code, in civil cases to fund the payment
145145 of the principal of, interest on, and costs of issuance of bonds
146146 issued for the construction, renovation, or improvement of court
147147 facilities, if authorized by the county commissioners court.
148148 Sec. 101.061195. ADDITIONAL DISTRICT COURT FEES FOR COURT
149149 FACILITIES: GOVERNMENT CODE. The clerk of a district court in
150150 Willacy County shall collect an additional filing fee of not more
151151 than $20 under Section 51.713, Government Code, in civil cases to
152152 fund the:
153153 (1) construction, renovation, or improvement of court
154154 facilities, if authorized by the county commissioners court; and
155155 (2) payment of the principal of, interest on, and
156156 costs of issuance of bonds issued for the construction, renovation,
157157 or improvement of court facilities, if authorized by the county
158158 commissioners court.
159159 SECTION 4. Subchapter E, Chapter 101, Government Code, is
160160 amended by adding Section 101.081193 to read as follows:
161161 Sec. 101.081193. ADDITIONAL STATUTORY COUNTY COURT FEES FOR
162162 COURT FACILITIES: GOVERNMENT CODE. The clerk of a statutory county
163163 court in Hidalgo County and the clerk of a statutory county court in
164164 Cameron County shall collect an additional filing fee of not more
165165 than $20 under Section 51.711, Government Code, in civil cases to
166166 fund the payment of the principal of, interest on, and costs of
167167 issuance of bonds issued for the construction, renovation, or
168168 improvement of court facilities, if authorized by the county
169169 commissioners court.
170170 SECTION 5. Subchapter F, Chapter 101, Government Code, is
171171 amended by adding Section 101.101192 to read as follows:
172172 Sec. 101.101192. ADDITIONAL STATUTORY PROBATE COURT FEES
173173 FOR COURT FACILITIES: GOVERNMENT CODE. The clerk of a statutory
174174 probate court in Hidalgo County shall collect an additional filing
175175 fee of not more than $20 under Section 51.711, Government Code, in
176176 civil cases to fund the payment of the principal of, interest on,
177177 and costs of issuance of bonds issued for the construction,
178178 renovation, or improvement of court facilities, if authorized by
179179 the county commissioners court.
180180 SECTION 6. Subchapter G, Chapter 101, Government Code, is
181181 amended by adding Section 101.12122 to read as follows:
182182 Sec. 101.12122. ADDITIONAL COUNTY COURT FEES FOR COURT
183183 FACILITIES: GOVERNMENT CODE. The clerk of the county court in
184184 Willacy County shall collect an additional filing fee of not more
185185 than $20 under Section 51.713, Government Code, in civil cases to
186186 fund the:
187187 (1) construction, renovation, or improvement of court
188188 facilities, if authorized by the county commissioners court; and
189189 (2) payment of the principal of, interest on, and
190190 costs of issuance of bonds issued for the construction, renovation,
191191 or improvement of court facilities, if authorized by the county
192192 commissioners court.
193193 SECTION 7. Subchapter H, Chapter 101, Government Code, is
194194 amended by adding Section 101.143 to read as follows:
195195 Sec. 101.143. ADDITIONAL JUSTICE COURT FEES FOR COURT
196196 FACILITIES COLLECTED BY CLERK. The clerk of a justice court in
197197 Willacy County shall collect an additional filing fee of not more
198198 than $20 under Section 51.713, Government Code, in civil cases to
199199 fund the:
200200 (1) construction, renovation, or improvement of court
201201 facilities, if authorized by the county commissioners court; and
202202 (2) payment of the principal of, interest on, and
203203 costs of issuance of bonds issued for the construction, renovation,
204204 or improvement of court facilities, if authorized by the county
205205 commissioners court.
206206 SECTION 8. This Act takes effect September 1, 2017.
