10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 130.0012, Education Code, is amended by |
---|
12 | 12 | | amending Subsections (a) and (g) and adding Subsections (b-4) and |
---|
13 | 13 | | (g-1) to read as follows: |
---|
14 | 14 | | (a) The Texas Higher Education Coordinating Board may |
---|
15 | 15 | | [shall] authorize public junior colleges to offer baccalaureate |
---|
16 | 16 | | degree programs in the fields of applied science, [and] applied |
---|
17 | 17 | | technology, and nursing under this section. Offering a |
---|
18 | 18 | | baccalaureate degree program under this section does not otherwise |
---|
19 | 19 | | alter the role and mission of a public junior college. |
---|
20 | 20 | | (b-4) The coordinating board shall authorize a public |
---|
21 | 21 | | junior college with a service area located wholly or partly in a |
---|
22 | 22 | | county with a population of less than 500,000 adjacent to the |
---|
23 | 23 | | northern boundary of a county with a population of more than three |
---|
24 | 24 | | million to offer a baccalaureate degree program in the field of |
---|
25 | 25 | | nursing. A degree program authorized under this subsection may be |
---|
26 | 26 | | offered under an articulation agreement as provided by Section |
---|
27 | 27 | | 29.908 with an early college education program located in the |
---|
28 | 28 | | service area of the public junior college. |
---|
29 | 29 | | (g) Except as provided by Subsection (g-1), in [In] its |
---|
30 | 30 | | recommendations to the legislature relating to state funding for |
---|
31 | 31 | | public junior colleges, the coordinating board shall recommend that |
---|
32 | 32 | | a public junior college receive substantially the same state |
---|
33 | 33 | | support for junior-level and senior-level courses offered under |
---|
34 | 34 | | this section as that provided to a general academic teaching |
---|
35 | 35 | | institution for substantially similar courses. In determining the |
---|
36 | 36 | | contact hours attributable to students enrolled in a junior-level |
---|
37 | 37 | | or senior-level course offered under this section used to determine |
---|
38 | 38 | | a public junior college's proportionate share of state |
---|
39 | 39 | | appropriations under Section 130.003, the coordinating board shall |
---|
40 | 40 | | weigh those contact hours as necessary to provide the junior |
---|
41 | 41 | | college the appropriate level of state support to the extent state |
---|
42 | 42 | | funds for those courses are included in the appropriations. This |
---|
43 | 43 | | subsection does not prohibit the legislature from directly |
---|
44 | 44 | | appropriating state funds to support junior-level and senior-level |
---|
45 | 45 | | courses offered under this section. |
---|
46 | 46 | | (g-1) A degree program created under Subsection (b-4) may be |
---|
47 | 47 | | funded only by a public junior college's proportionate share of |
---|
48 | 48 | | state appropriations under Section 130.003, local funds, and |
---|
49 | 49 | | private sources. This subsection does not require the legislature |
---|
50 | 50 | | to appropriate state funds to support a degree program created |
---|
51 | 51 | | under Subsection (b-4). |
---|
52 | 52 | | SECTION 2. This Act takes effect September 1, 2017. |
