7 | 7 | | relating to school districts of innovation. |
---|
8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 12A.003(b), Education Code, is amended |
---|
10 | 10 | | to read as follows: |
---|
11 | 11 | | (b) A local innovation plan must: |
---|
12 | 12 | | (1) provide for a comprehensive educational program |
---|
13 | 13 | | for the district, which [program] may include: |
---|
14 | 14 | | (A) innovative curriculum, instructional |
---|
15 | 15 | | methods, and provisions regarding community participation, campus |
---|
16 | 16 | | governance, and parental involvement; |
---|
17 | 17 | | (B) modifications to the school day or year; |
---|
18 | 18 | | (C) provisions regarding the district budget and |
---|
19 | 19 | | sustainable program funding; |
---|
20 | 20 | | (D) accountability and assessment measures that |
---|
21 | 21 | | exceed the requirements of state and federal law; and |
---|
22 | 22 | | (E) any other innovations prescribed by the board |
---|
23 | 23 | | of trustees; [and] |
---|
24 | 24 | | (2) identify requirements imposed by this code that |
---|
25 | 25 | | inhibit the goals of the plan and from which the district should be |
---|
26 | 26 | | exempted on adoption of the plan, subject to Section 12A.004; and |
---|
27 | 27 | | (3) include a detailed explanation of the manner in |
---|
28 | 28 | | which each requirement identified under Subdivision (2) inhibits |
---|
29 | 29 | | the goals of the plan. |
---|
30 | 30 | | SECTION 2. Section 12A.004(a), Education Code, is amended |
---|
31 | 31 | | to read as follows: |
---|
32 | 32 | | (a) A local innovation plan may not provide for the |
---|
33 | 33 | | exemption of a district designated as a district of innovation from |
---|
34 | 34 | | a provision of this chapter or the following provisions of this |
---|
35 | 35 | | title: |
---|
36 | 36 | | (1) a state or federal requirement applicable to an |
---|
37 | 37 | | open-enrollment charter school operating under Subchapter D, |
---|
38 | 38 | | Chapter 12; |
---|
39 | 39 | | (2) Subchapters A, C, D, and E, Chapter 11, except that |
---|
40 | 40 | | a district may be exempt from Sections 11.1511(b)(5) and (14) and |
---|
41 | 41 | | Section 11.162; |
---|
42 | 42 | | (3) Chapters 21 and 22; |
---|
43 | 43 | | (4) elementary school class size limits under Section |
---|
44 | 44 | | 25.112; |
---|
45 | 45 | | (5) state curriculum and graduation requirements |
---|
46 | 46 | | adopted under Chapter 28; |
---|
47 | 47 | | (6) Chapter 37; and |
---|
48 | 48 | | (7) [(4)] academic and financial accountability and |
---|
49 | 49 | | sanctions under Chapter 39. |
---|
50 | 50 | | SECTION 3. Sections 12A.003 and 12A.004, Education Code, as |
---|
51 | 51 | | amended by this Act, apply only to a local innovation plan adopted |
---|
52 | 52 | | or renewed on or after the effective date of this Act. A local |
---|
53 | 53 | | innovation plan adopted or renewed before the effective date of |
---|
54 | 54 | | this Act is governed by the law in effect on the date the plan was |
---|
55 | 55 | | adopted or renewed, and the former law is continued in effect for |
---|
56 | 56 | | that purpose. |
---|
57 | 57 | | SECTION 4. This Act takes effect immediately if it receives |
---|
58 | 58 | | a vote of two-thirds of all the members elected to each house, as |
---|
59 | 59 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
60 | 60 | | Act does not receive the vote necessary for immediate effect, this |
---|
61 | 61 | | Act takes effect September 1, 2017. |
