55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to school districts of innovation.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 12A.003(b), Education Code, is amended
1010 to read as follows:
1111 (b) A local innovation plan must:
1212 (1) provide for a comprehensive educational program
1313 for the district, which [program] may include:
1414 (A) innovative curriculum, instructional
1515 methods, and provisions regarding community participation, campus
1616 governance, and parental involvement;
1717 (B) modifications to the school day or year;
1818 (C) provisions regarding the district budget and
1919 sustainable program funding;
2020 (D) accountability and assessment measures that
2121 exceed the requirements of state and federal law; and
2222 (E) any other innovations prescribed by the board
2323 of trustees; [and]
2424 (2) identify requirements imposed by this code that
2525 inhibit the goals of the plan and from which the district should be
2626 exempted on adoption of the plan, subject to Section 12A.004; and
2727 (3) include a detailed explanation of the manner in
2828 which each requirement identified under Subdivision (2) inhibits
2929 the goals of the plan.
3030 SECTION 2. Section 12A.004(a), Education Code, is amended
3131 to read as follows:
3232 (a) A local innovation plan may not provide for the
3333 exemption of a district designated as a district of innovation from
3434 a provision of this chapter or the following provisions of this
3535 title:
3636 (1) a state or federal requirement applicable to an
3737 open-enrollment charter school operating under Subchapter D,
3838 Chapter 12;
3939 (2) Subchapters A, C, D, and E, Chapter 11, except that
4040 a district may be exempt from Sections 11.1511(b)(5) and (14) and
4141 Section 11.162;
4242 (3) Chapters 21 and 22;
4343 (4) elementary school class size limits under Section
4444 25.112;
4545 (5) state curriculum and graduation requirements
4646 adopted under Chapter 28;
4747 (6) Chapter 37; and
4848 (7) [(4)] academic and financial accountability and
4949 sanctions under Chapter 39.
5050 SECTION 3. Sections 12A.003 and 12A.004, Education Code, as
5151 amended by this Act, apply only to a local innovation plan adopted
5252 or renewed on or after the effective date of this Act. A local
5353 innovation plan adopted or renewed before the effective date of
5454 this Act is governed by the law in effect on the date the plan was
5555 adopted or renewed, and the former law is continued in effect for
5656 that purpose.
5757 SECTION 4. This Act takes effect immediately if it receives
5858 a vote of two-thirds of all the members elected to each house, as
5959 provided by Section 39, Article III, Texas Constitution. If this
6060 Act does not receive the vote necessary for immediate effect, this
6161 Act takes effect September 1, 2017.
