55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the criteria for issuing a silver alert for a missing
88 senior citizen.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 411.381(3), Government Code, is amended
1111 to read as follows:
1212 (3) "Senior citizen" means a person who is 55 [65]
1313 years of age or older.
1414 SECTION 2. Section 411.386, Government Code, is amended by
1515 amending Subsection (a) and adding Subsection (c) to read as
1616 follows:
1717 (a) A local law enforcement agency may notify the department
1818 if the agency:
1919 (1) receives notice of a missing senior citizen;
2020 (2) verifies that at the time the senior citizen is
2121 reported missing:
2222 (A) the person reported missing is 55 [65] years
2323 of age or older;
2424 (B) the senior citizen's location is unknown; and
2525 (C) the senior citizen has an impaired mental
2626 condition; and
2727 (3) determines that the senior citizen's disappearance
2828 poses a credible threat to the senior citizen's health and safety.
2929 (c) The family or legal guardian of a missing senior citizen
3030 may provide documentation as required by Subsection (b)(1) by
3131 submitting to the local law enforcement agency an affidavit stating
3232 that the senior citizen has an impaired mental condition. The local
3333 law enforcement agency may not require additional documentation
3434 under Subsection (b)(1) from a family or legal guardian who submits
3535 an affidavit as described by this subsection.
3636 SECTION 3. This Act takes effect September 1, 2017.
