| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 54.5041(h), Education Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (h) The fee may not be charged after the fifth academic year | |
| 13 | 13 | following the most recent academic year in which the fee was | |
| 14 | 14 | approved by a majority vote of the students enrolled at the | |
| 15 | 15 | institution unless the fee is reauthorized and approved by a | |
| 16 | 16 | majority vote of the students enrolled at the institution | |
| 17 | 17 | participating in a new general student election called for that | |
| 18 | 18 | purpose [in which the fee is first charged unless, before the end of | |
| 19 | 19 | that academic year, the institution has issued bonds payable in | |
| 20 | 20 | whole or in part from the fee, in which event the fee may not be | |
| 21 | 21 | charged after the academic year in which all such bonds, including | |
| 22 | 22 | refunding bonds for those bonds, have been fully paid]. | |
| 23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2017. |
