76 relating to establishing a Federal Medicaid Funding and Reform
87 Waivers Legislative Oversight Committee.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. The heading to Chapter 537, Government Code, is
1110 amended to read as follows:
1211 CHAPTER 537. FEDERAL MEDICAID FUNDING AND REFORM WAIVERS [WAIVER]
1312 SECTION 2. Chapter 537, Government Code, is amended by
1413 adding Section 537.001 to read as follows:
1514 Sec. 537.001. FEDERAL MEDICAID FUNDING AND REFORM WAIVERS
1615 LEGISLATIVE OVERSIGHT COMMITTEE. (a) In this section:
1716 (1) "Committee" means the Federal Medicaid Funding and
1817 Reform Waivers Legislative Oversight Committee created under this
1918 section.
2019 (2) "Medicaid block grant funding system" means a
2120 system of funding Medicaid that provides for a set total amount of
2221 federal financial participation regardless of program enrollment.
2322 (3) "Medicaid per capita cap funding system" means a
2423 system of funding Medicaid that provides for a set amount of federal
2524 financial participation per Medicaid enrollee, subject to a preset
2625 cost adjustment factor.
2726 (b) The Federal Medicaid Funding and Reform Waivers
2827 Legislative Oversight Committee is created as provided by this
2928 section if:
3029 (1) the federal government authorizes states to opt to
3130 receive the federal share of money for the operation of Medicaid
3231 through a Medicaid block grant funding system or a Medicaid per
3332 capita cap funding system or requires that states receive that
3433 money through a Medicaid block grant funding system or a Medicaid
3534 per capita cap funding system; or
3635 (2) the executive commissioner seeks a waiver under
3736 Section 537.002.
3837 (c) The committee is composed of eight members, as follows:
3938 (1) four members of the senate, appointed by the
4039 lieutenant governor; and
4140 (2) four members of the house of representatives,
4241 appointed by the speaker of the house of representatives.
4342 (d) A member of the committee serves at the pleasure of the
4443 appointing official.
4544 (e) The lieutenant governor and speaker of the house of
4645 representatives shall each designate a co-chair from among the
4746 committee members.
4847 (f) A member of the committee may not receive compensation
4948 for serving on the committee but is entitled to reimbursement for
5049 travel expenses incurred by the member while conducting the
5150 business of the committee as provided by the General Appropriations
5251 Act.
5352 (g) The committee shall:
5453 (1) facilitate the design and development of:
5554 (A) a Medicaid block grant waiver or Medicaid per
5655 capita cap waiver, as applicable, if the federal government
5756 authorizes states to opt to receive the federal share of money for
5857 the operation of Medicaid through a Medicaid block grant funding
5958 system or a Medicaid per capita cap funding system or requires that
6059 states receive that money through a Medicaid block grant funding
6160 system or a Medicaid per capita cap funding system; or
6261 (B) any waiver sought under Section 537.002;
6362 (2) facilitate a smooth transition from existing
6463 Medicaid payment systems and benefit designs to a new model of
6564 Medicaid that is enabled by a waiver described by Subdivision (1);
6665 (3) meet at the call of the co-chairs; and
6766 (4) research, take public testimony, and issue reports
6867 requested by the lieutenant governor or speaker of the house of
6968 representatives.
7069 (h) The committee may request reports and other information
7170 from the commission.
7271 (i) The committee shall use existing staff of the senate,
7372 the house of representatives, and the Texas Legislative Council to
7473 assist the committee in performing its duties under this section.
7574 (j) Chapter 551 applies to the committee.
7675 SECTION 3. This Act takes effect immediately if it receives
7776 a vote of two-thirds of all the members elected to each house, as
7877 provided by Section 39, Article III, Texas Constitution. If this
7978 Act does not receive the vote necessary for immediate effect, this
8079 Act takes effect September 1, 2017.
