44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the filing of certain actions involving preauthorized
77 medical care or health care services in the Medicaid program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 531.102(g)(9), Government Code, is
1010 amended by adding Subsection (9-a) to read as follows:
1111 (9-a) The state may not file a civil action for fraud against
1212 a physician or health care provider for prior authorized medically
1313 necessary services unless the physician or provider has materially
1414 misrepresented the documentation relating to the medical or health
1515 care services or has substantially failed to perform the medical or
1616 health care services.
1717 SECTION 2. The changes in law made by this Act apply only to
1818 a civil action commenced on or after the effective date of this
1919 Act. A civil action commenced before the effective date of this
2020 Act is governed by the law applicable to the action immediately
2121 before the effective date of this Act, and that law is continued in
2222 effect for that purpose.
2323 SECTION 3. This Act takes effect September 1, 2017.
