8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 531.102(g)(9), Government Code, is | |
10 | 10 | amended by adding Subsection (9-a) to read as follows: | |
11 | 11 | (9-a) The state may not file a civil action for fraud against | |
12 | 12 | a physician or health care provider for prior authorized medically | |
13 | 13 | necessary services unless the physician or provider has materially | |
14 | 14 | misrepresented the documentation relating to the medical or health | |
15 | 15 | care services or has substantially failed to perform the medical or | |
16 | 16 | health care services. | |
17 | 17 | SECTION 2. The changes in law made by this Act apply only to | |
18 | 18 | a civil action commenced on or after the effective date of this | |
19 | 19 | Act. A civil action commenced before the effective date of this | |
20 | 20 | Act is governed by the law applicable to the action immediately | |
21 | 21 | before the effective date of this Act, and that law is continued in | |
22 | 22 | effect for that purpose. | |
23 | 23 | SECTION 3. This Act takes effect September 1, 2017. |
