| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 213, Subtitle A, Title 4, Labor Code, is |
|---|
| 11 | 11 | | amended by adding Section 213.012 to read as follows: |
|---|
| 12 | 12 | | Sec. 213.012. RESTRICTED OR CONDITIONAL PAYMENTS |
|---|
| 13 | 13 | | PROHIBITED. A restriction or condition placed on a negotiable |
|---|
| 14 | 14 | | instrument or any other form of payment, physical or electronic, in |
|---|
| 15 | 15 | | payment of contributions, penalties, or interest by the maker that |
|---|
| 16 | 16 | | limits the amount of contributions, penalties, or interest owed to |
|---|
| 17 | 17 | | an amount less than that calculated under this subtitle, reflected |
|---|
| 18 | 18 | | on the statement of account, or shown by commission records, is void |
|---|
| 19 | 19 | | unless the restriction or condition is authorized by this code. |
|---|
| 20 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 24 | | Act takes effect September 1, 2017. |
