55 AN ACT
66 relating to allowing the Texas Workforce Commission (Commission) to
77 cash a warrant with a restricted or conditional endorsement without
88 settling the amount of money due to the Commission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 213, Subtitle A, Title 4, Labor Code, is
1111 amended by adding Section 213.012 to read as follows:
1212 Sec. 213.012. RESTRICTED OR CONDITIONAL PAYMENTS
1313 PROHIBITED. A restriction or condition placed on a negotiable
1414 instrument or any other form of payment, physical or electronic, in
1515 payment of contributions, penalties, or interest by the maker that
1616 limits the amount of contributions, penalties, or interest owed to
1717 an amount less than that calculated under this subtitle, reflected
1818 on the statement of account, or shown by commission records, is void
1919 unless the restriction or condition is authorized by this code.
2020 SECTION 2. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2017.
