79 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
810 SECTION 1. Chapter 1001, Health and Safety Code, is amended
911 by adding Subchapter J to read as follows:
1012 SUBCHAPTER J. MATERNAL MORTALITY REPORTING AND INVESTIGATION
1113 INFORMATION
1214 Sec. 1001.241. MATERNAL MORTALITY REPORTING AND
1315 INVESTIGATION INFORMATION. (a) The department shall post on the
1416 department's Internet website information regarding the systematic
1517 protocol for pregnancy-related death investigations and the best
1618 practices for reporting pregnancy-related deaths to the medical
1719 examiner or justice of the peace of each county, as applicable.
1820 (b) The information provided under Subsection (a) must
1921 include guidelines for:
2022 (1) determining when a comprehensive toxicology
2123 screening should be performed on a person whose death was related to
2224 pregnancy;
2325 (2) determining when a death should be reported to or
2426 investigated by a medical examiner or justice of the peace under
2527 Chapter 49, Code of Criminal Procedure; and
2628 (3) correctly completing the death certificate of a
2729 person whose death was related to pregnancy.
2830 (c) The executive commissioner shall adopt rules as
2931 necessary to implement this section.
3032 SECTION 2. This Act takes effect September 1, 2017.
