| 7 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 10 | | SECTION 1. Chapter 1001, Health and Safety Code, is amended |
|---|
| 9 | 11 | | by adding Subchapter J to read as follows: |

| 10 | 12 | | SUBCHAPTER J. MATERNAL MORTALITY REPORTING AND INVESTIGATION |

| 11 | 13 | | INFORMATION |

| 12 | 14 | | Sec. 1001.241. MATERNAL MORTALITY REPORTING AND |
|---|
| 13 | 15 | | INVESTIGATION INFORMATION. (a) The department shall post on the |
|---|
| 14 | 16 | | department's Internet website information regarding the systematic |
|---|
| 15 | 17 | | protocol for pregnancy-related death investigations and the best |
|---|
| 16 | 18 | | practices for reporting pregnancy-related deaths to the medical |
|---|
| 17 | 19 | | examiner or justice of the peace of each county, as applicable. |
|---|
| 18 | 20 | | (b) The information provided under Subsection (a) must |
|---|
| 19 | 21 | | include guidelines for: |
|---|
| 20 | 22 | | (1) determining when a comprehensive toxicology |
|---|
| 21 | 23 | | screening should be performed on a person whose death was related to |
|---|
| 22 | 24 | | pregnancy; |
|---|
| 23 | 25 | | (2) determining when a death should be reported to or |
|---|
| 24 | 26 | | investigated by a medical examiner or justice of the peace under |
|---|
| 25 | 27 | | Chapter 49, Code of Criminal Procedure; and |
|---|
| 26 | 28 | | (3) correctly completing the death certificate of a |
|---|
| 27 | 29 | | person whose death was related to pregnancy. |
|---|
| 28 | 30 | | (c) The executive commissioner shall adopt rules as |
|---|
| 29 | 31 | | necessary to implement this section. |
|---|
| 30 | 32 | | SECTION 2. This Act takes effect September 1, 2017. |
