410 A BILL TO BE ENTITLED
511 AN ACT
612 relating to the availability of certain school district financial
713 information on certain districts' Internet websites.
814 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
915 SECTION 1. Chapter 44, Education Code, is amended by adding
1016 Subchapter D to read as follows:
1117 SUBCHAPTER D. FINANCIAL DISCLOSURE
1218 Sec. 44.101. APPLICABILITY. This subchapter applies only
1319 to a school district that is ranked among the 50 highest in student
1420 enrollment, as determined by the commissioner.
1521 Sec. 44.102. FINANCIAL DISCLOSURE. (a) A school district
1622 shall maintain on the district's Internet website an electronic
1723 database of district finances. The database must include:
1824 (1) for the immediately preceding fiscal year:
1925 (A) total expenditures as a dollar amount and a
2026 dollar amount per student in average daily attendance;
2127 (B) total revenue as a dollar amount and a dollar
2228 amount per student in average daily attendance;
2329 (C) total revenue from property taxes as a dollar
2430 amount and a dollar amount per student in average daily attendance;
2531 and
2632 (D) the total number of full-time equivalent
2733 positions for the district;
2834 (2) a graphical representation of the district's
2935 operating and debt service funds, including:
3036 (A) the total budgeted allocation and per student
3137 in average daily attendance allocation by function and major object
3238 for the current school year; and
3339 (B) the actual revenues and expenditures by
3440 function and major object for each of the four preceding fiscal
3541 years;
3642 (3) the district's annual financial report for the
3743 preceding five fiscal years;
3844 (4) in a searchable electronic format:
3945 (A) the transaction register for each district
4046 checking account, including for each check written from a district
4147 checking account:
4248 (i) the transaction amount;
4349 (ii) the name of the payee;
4450 (iii) the date the check was issued; and
4551 (iv) a statement of the purpose of the
4652 expenditure for which the check was written; and
4753 (B) a board financial report, updated at least
4854 quarterly, comparing revenues and expenditures with:
4955 (i) the adopted and amended budget; and
5056 (ii) revenues and expenditures from the
5157 preceding fiscal year;
5258 (5) a visualization chart depicting district
5359 financial data trends for the preceding five fiscal years that
5460 shows for each fiscal year:
5561 (A) total expenditures per student in average
5662 daily attendance;
5763 (B) total revenue per student in average daily
5864 attendance; and
5965 (C) the district property tax rate expressed in
6066 dollars per $100 valuation;
6167 (6) contact information for the district and members
6268 of the board of trustees of the district; and
6369 (7) a link to a web page maintained by the district
6470 that provides instructions for submitting a request for information
6571 under Chapter 552, Government Code.
6672 (b) The district's annual financial report for the current
6773 fiscal year must be posted not later than the first anniversary of
6874 the end of the fiscal year.
6975 (c) A school district shall:
7076 (1) update the electronic checking account
7177 transaction register at least once each month, not later than the
7278 30th day after the closing date of the most recent monthly statement
7379 for the checking account;
7480 (2) maintain each transaction or listing in the
7581 electronic checking account transaction register on the district's
7682 Internet website until at least the third anniversary of the date of
7783 the transaction or listing; and
7884 (3) for each fiscal year that transactions and
7985 listings are included in the electronic checking account
8086 transaction register, group together the transactions and listings
8187 by fiscal year.
8288 SECTION 2. This Act takes effect September 1, 2018.
