8 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 15 | | SECTION 1. Chapter 44, Education Code, is amended by adding |
---|
10 | 16 | | Subchapter D to read as follows: |
---|
11 | 17 | | SUBCHAPTER D. FINANCIAL DISCLOSURE |
---|
12 | 18 | | Sec. 44.101. APPLICABILITY. This subchapter applies only |
---|
13 | 19 | | to a school district that is ranked among the 50 highest in student |
---|
14 | 20 | | enrollment, as determined by the commissioner. |
---|
15 | 21 | | Sec. 44.102. FINANCIAL DISCLOSURE. (a) A school district |
---|
16 | 22 | | shall maintain on the district's Internet website an electronic |
---|
17 | 23 | | database of district finances. The database must include: |
---|
18 | 24 | | (1) for the immediately preceding fiscal year: |
---|
19 | 25 | | (A) total expenditures as a dollar amount and a |
---|
20 | 26 | | dollar amount per student in average daily attendance; |
---|
21 | 27 | | (B) total revenue as a dollar amount and a dollar |
---|
22 | 28 | | amount per student in average daily attendance; |
---|
23 | 29 | | (C) total revenue from property taxes as a dollar |
---|
24 | 30 | | amount and a dollar amount per student in average daily attendance; |
---|
25 | 31 | | and |
---|
26 | 32 | | (D) the total number of full-time equivalent |
---|
27 | 33 | | positions for the district; |
---|
28 | 34 | | (2) a graphical representation of the district's |
---|
29 | 35 | | operating and debt service funds, including: |
---|
30 | 36 | | (A) the total budgeted allocation and per student |
---|
31 | 37 | | in average daily attendance allocation by function and major object |
---|
32 | 38 | | for the current school year; and |
---|
33 | 39 | | (B) the actual revenues and expenditures by |
---|
34 | 40 | | function and major object for each of the four preceding fiscal |
---|
35 | 41 | | years; |
---|
36 | 42 | | (3) the district's annual financial report for the |
---|
37 | 43 | | preceding five fiscal years; |
---|
38 | 44 | | (4) in a searchable electronic format: |
---|
39 | 45 | | (A) the transaction register for each district |
---|
40 | 46 | | checking account, including for each check written from a district |
---|
41 | 47 | | checking account: |
---|
42 | 48 | | (i) the transaction amount; |
---|
43 | 49 | | (ii) the name of the payee; |
---|
44 | 50 | | (iii) the date the check was issued; and |
---|
45 | 51 | | (iv) a statement of the purpose of the |
---|
46 | 52 | | expenditure for which the check was written; and |
---|
47 | 53 | | (B) a board financial report, updated at least |
---|
48 | 54 | | quarterly, comparing revenues and expenditures with: |
---|
49 | 55 | | (i) the adopted and amended budget; and |
---|
50 | 56 | | (ii) revenues and expenditures from the |
---|
51 | 57 | | preceding fiscal year; |
---|
52 | 58 | | (5) a visualization chart depicting district |
---|
53 | 59 | | financial data trends for the preceding five fiscal years that |
---|
54 | 60 | | shows for each fiscal year: |
---|
55 | 61 | | (A) total expenditures per student in average |
---|
56 | 62 | | daily attendance; |
---|
57 | 63 | | (B) total revenue per student in average daily |
---|
58 | 64 | | attendance; and |
---|
59 | 65 | | (C) the district property tax rate expressed in |
---|
60 | 66 | | dollars per $100 valuation; |
---|
61 | 67 | | (6) contact information for the district and members |
---|
62 | 68 | | of the board of trustees of the district; and |
---|
63 | 69 | | (7) a link to a web page maintained by the district |
---|
64 | 70 | | that provides instructions for submitting a request for information |
---|
65 | 71 | | under Chapter 552, Government Code. |
---|
66 | 72 | | (b) The district's annual financial report for the current |
---|
67 | 73 | | fiscal year must be posted not later than the first anniversary of |
---|
68 | 74 | | the end of the fiscal year. |
---|
69 | 75 | | (c) A school district shall: |
---|
70 | 76 | | (1) update the electronic checking account |
---|
71 | 77 | | transaction register at least once each month, not later than the |
---|
72 | 78 | | 30th day after the closing date of the most recent monthly statement |
---|
73 | 79 | | for the checking account; |
---|
74 | 80 | | (2) maintain each transaction or listing in the |
---|
75 | 81 | | electronic checking account transaction register on the district's |
---|
76 | 82 | | Internet website until at least the third anniversary of the date of |
---|
77 | 83 | | the transaction or listing; and |
---|
78 | 84 | | (3) for each fiscal year that transactions and |
---|
79 | 85 | | listings are included in the electronic checking account |
---|
80 | 86 | | transaction register, group together the transactions and listings |
---|
81 | 87 | | by fiscal year. |
---|
82 | 88 | | SECTION 2. This Act takes effect September 1, 2018. |
