54 A BILL TO BE ENTITLED
65 AN ACT
76 relating to a reduction in required days of service for educators in
87 public schools under certain circumstances.
98 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
109 SECTION 1. Section 21.401, Education Code, is amended by
1110 amending Subsection (b) and adding Subsection (c-1) to read as
1211 follows:
1312 (b) Except as provided by Subsection (c-1), an [An] educator
1413 employed under a 10-month contract must provide a minimum of 187
1514 days of service.
1615 (c-1) If a school district anticipates providing less than
1716 180 days of instruction for students during a school year, as
1817 indicated by the district's academic calendar, the district may
1918 reduce the number of days of service required by this section
2019 proportionately. A reduction by the district does not reduce an
2120 educator's salary.
2221 SECTION 2. Section 21.401, Education Code, as amended by
2322 this Act, applies only to a contract executed on or after the
2423 effective date of this Act. A contract executed before the
2524 effective date of this Act is governed by the law in effect on the
2625 date the contract was executed, and the former law is continued in
2726 effect for that purpose.
2827 SECTION 3. This Act takes effect immediately if it receives
2928 a vote of two-thirds of all the members elected to each house, as
3029 provided by Section 39, Article III, Texas Constitution. If this
3130 Act does not receive the vote necessary for immediate effect, this
3231 Act takes effect September 1, 2017.
