44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the career and technology education allotment and the
77 essential knowledge and skills of the career and technology
88 education and technology applications curriculums.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 42.154(a), (b), (c), and (e), Education
1111 Code, are amended to read as follows:
1212 (a) For each full-time equivalent student in average daily
1313 attendance in an approved career and technology education program
1414 or an approved technology applications course in grades nine
1515 through 12 or in career and technology education programs for
1616 students with disabilities in grades seven through 12, a district
1717 is entitled to:
1818 (1) an annual allotment equal to the adjusted basic
1919 allotment multiplied by a weight of 1.35; and
2020 (2) $50, if the student is enrolled in:
2121 (A) two or more advanced career and technology
2222 education courses [classes] for a total of three or more credits;
2323 (B) two or more advanced technology applications
2424 courses for a total of three or more credits; or
2525 (C) [(B)] an advanced course as part of a
2626 tech-prep program under Subchapter T, Chapter 61.
2727 (b) In this section, "full-time equivalent student" means
2828 30 hours of contact a week between a student and career and
2929 technology education program or technology applications personnel.
3030 (c) Funds allocated under this section, other than an
3131 indirect cost allotment established under State Board of Education
3232 rule, must be used in providing career and technology education
3333 programs and technology applications courses in grades nine through
3434 12 or career and technology education programs for students with
3535 disabilities in grades seven through 12 under Sections 29.182,
3636 29.183, and 29.184.
3737 (e) Out of the total statewide allotment [for career and
3838 technology education] under this section, the commissioner shall
3939 set aside an amount specified in the General Appropriations Act,
4040 which may not exceed an amount equal to one percent of the total
4141 amount appropriated, to support regional career and technology
4242 education planning. After deducting the amount set aside under
4343 this subsection from the total amount appropriated for career and
4444 technology education and technology applications under this
4545 section, the commissioner shall reduce each district's tier one
4646 allotments in the same manner described for a reduction in
4747 allotments under Section 42.253.
4848 SECTION 2. Section 42.101(a), Education Code, is amended to
4949 read as follows:
5050 (a) For each student in average daily attendance, not
5151 including the time students spend each day in special education
5252 programs in an instructional arrangement other than mainstream
5353 programs, [or] career and technology education programs, or
5454 technology applications courses, for which an additional allotment
5555 is made under Subchapter C, a district is entitled to an allotment
5656 equal to the lesser of $4,765 or the amount that results from the
5757 following formula:
5858 A = $4,765 X (DCR/MCR)
5959 where:
6060 "A" is the allotment to which a district is entitled;
6161 "DCR" is the district's compressed tax rate, which is the
6262 product of the state compression percentage, as determined under
6363 Section 42.2516, multiplied by the maintenance and operations tax
6464 rate adopted by the district for the 2005 tax year; and
6565 "MCR" is the state maximum compressed tax rate, which is the
6666 product of the state compression percentage, as determined under
6767 Section 42.2516, multiplied by $1.50.
6868 SECTION 3. Not later than March 1, 2018, the State Board of
6969 Education shall:
7070 (1) conduct a review of the essential knowledge and
7171 skills of the career and technology and technology applications
7272 curriculums; and
7373 (2) amend the board's rules in the Texas
7474 Administrative Code to consolidate the technology applications
7575 courses for grades nine through 12 in 19 T.A.C. Chapter 126,
7676 Subchapter C, with the career and technology education courses in
7777 19 T.A.C. Chapter 130, and eliminate duplicative courses while
7878 ensuring certifications are aligned with the rigor of each
7979 individual course.
8080 SECTION 4. This Act applies beginning with the 2018-2019
8181 school year.
8282 SECTION 5. This Act takes effect immediately if it receives
8383 a vote of two-thirds of all the members elected to each house, as
8484 provided by Section 39, Article III, Texas Constitution. If this
8585 Act does not receive the vote necessary for immediate effect, this
8686 Act takes effect September 1, 2017.
