66 AN ACT
77 relating to requiring a canvassing authority to explain a
88 discrepancy between the number of voters accepted and the ballots
99 cast in an election.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 67.004, Election Code, is amended by
1212 adding Subsection (g) to read as follows:
1313 (g) The canvassing authority may not enter a tabulation
1414 under Subsection (c) or deliver a tabulation under Subsections (e)
1515 and (f) if a discrepancy between the total number of ballots cast in
1616 the precinct and the total number of voters who cast a ballot for a
1717 candidate or for or against a measure in the election in the
1818 precinct is greater than one percent until the presiding officer of
1919 the canvassing authority posts an explanation of the discrepancy on
2020 the canvassing authority's Internet website.
2121 SECTION 2. This Act takes effect September 1, 2017.
